The administrator said that he would transfer her 18 yuan in red envelopes, and then said that he had mistakenly transferred 8888 yuan, threatening to return the money or his parents would go to jail. Xiaomeng did not receive any money, but because she was afraid, she asked her mother to brush her face and was transferred 29999.5 yuan. In order to get the money back, Xiaomeng's mother transferred 30,000 yuan successively according to the requirements of the other party, until the balance was insufficient before she realized that she had been deceived.

To be honest, seeing this news is quite speechless, the 6th grade child was deceived, why did the mother go forward to relay and was still deceived by 30,000 people?
The means of this scam are not clever, that is, a common case of network fraud, the family must not have installed the national anti-fraud APP, otherwise it would not be so easily deceived!
1. What kind of punishment will be imposed on the scammer?
Fraud refers to the act of defrauding a relatively large amount of public or private property for the purpose of illegal possession, using fictitious facts or concealing the truth.
In this case, the fraudster fictitiously wanted to transfer 18 yuan to Xiaomeng in a red envelope, and then claimed that he had mistakenly transferred 8888 yuan, threatening him to return the money, otherwise his parents would go to jail, the purpose of which was to let Xiaomeng transfer money, so as to achieve the purpose of illegal possession, and was undoubtedly suspected of committing fraud.
According to the provisions of the Judicial Interpretation on handling criminal cases of fraud, the sentencing for fraud crimes is divided into different grades, and the amount of 3,000 to 10,000 yuan or more is a relatively large amount; 30,000 to 100,000 yuan or more is a huge amount; and more than 500,000 yuan is a particularly huge amount.
In this case, the mother and daughter were defrauded of a total of 60,000 yuan, which is a huge amount of money, and is generally sentenced to 3-10 years imprisonment and a fine.
At the same time, the judicial interpretation emphasizes that those who use network telecommunications to commit fraud against an unspecified number of people shall be severely punished according to the crime of fraud as appropriate.
Therefore, the scammers in this case will face more than 3 years in prison after being caught.
2. Can the money that The little dream mother and daughter have been cheated out of can still get back?
The 60,000 yuan that Xiaomeng's mother and daughter were defrauded of belonged to the stolen money, and if the scammer was caught, the police would return it to the victim, Xiaomeng's mother and daughter.
However, this has a premise, that is, the money has not been squandered or transferred, if the scammer is caught running out of money, Xiaomeng mother and daughter can only file a criminal incidental civil lawsuit to demand compensation from the scammer, but if there is no money, the final access is just a blank piece of paper.
