The most famous one is that in 2013, on the big screen of Jilin Railway Station, an indecent clip from an erotic movie in Hong Kong suddenly played for about 10 minutes, but there was no sound.
Afterwards, the maintenance worker Yuan Mou admitted that at that time, he mistakenly thought that the computer playing the LED screen had disconnected the large screen, so he put a disc on this computer and watched an indecent video.
This time this incident, I don't know what the reason for this situation.
Ms. Zhou, the store's public relations, said that after the incident, they checked the surveillance at the time, and when the indecent video was played, all the clerks did not operate the mobile phone, so it should not be the clerk.'s work. Since the serial number can only be saved for 4 hours in the background, it requires an investigation by the information experts of the police. At present, the police's information experts have intervened, and they can quickly find out the people who maliciously cast the screen.
The serial number mentioned here should be the serial number of the device connected to the large screen, and through the serial number, it can be determined which device was connected to the video cast on the large screen at that time, and then find the person who did it accordingly.
So, what will the police do if they find the relevant personnel? Does this person constitute a crime?
The crime most likely to be involved in this act is probably the crime of spreading obscene material. However, according to relevant judicial interpretations, the dissemination of obscene information that is not for profit needs to be clicked 20,000 times, that is, the number of viewers must reach 20,000 times to achieve it. In this incident, I am afraid that the number of people watching it cannot be so many. This person who cast the screen is probably not up to the level of crime.
Some say that even if it does not constitute a crime, it must be punished.
Indeed, according to article 68 of the Public Security Administration Punishment Law, whoever disseminates obscene information shall be detained for not less than 10 days but not more than 15 days and may also be fined not more than 3,000 yuan; if the circumstances are less serious, he shall be detained for not more than 5 days or fined not more than 500 yuan.
However, the premise of constituting an illegal or criminal act here is that the perpetrator has the intention to spread. That is to say, the act, regardless of its underlying motivation, must be intentional. If it is an unintentional act like the maintenance worker at the Jilin Railway Station, I am afraid it is difficult to determine that there is a violation of the law and a crime. After all, the act of disseminating obscene material cannot be constituted by negligence.
Therefore, after finding that person, the motivation and reason are the focus of the investigation and interrogation.
However, even if this person is inadvertently wrong, this kind of behavior is not a public security violation and a crime, and it has already constituted an infringement in civil terms, which has brought harm to the goodwill of the store, and according to the provisions of the Civil Code, it is also necessary to bear the responsibility for the store, including restoring the reputation, eliminating the impact, and compensating for losses.
