As early as 1995, the Ministry of Public Security issued the "Notice on Strictly Prohibiting Unauthorized Intervention in Economic Disputes", emphasizing that the police should not interfere in economic disputes beyond their authority. Since then, various localities have also issued similar notices and requirements.

For this situation, the police can only consider the safety of the elderly and send the elderly home, which is both to ensure the safety of the elderly and the normal work process. It is no longer right for the daughter and son-in-law not to accept the elderly, and it also hinders the police from leaving, and it is even more an obstacle to the police from performing their official duties.

As for the scratching and injuring of the police, they have committed the crime of attacking the police, which was newly introduced last year.

Article 277 of the Criminal Law stipulates: "Whoever violently attacks a people's policeman who is lawfully performing his duties shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance; ”

According to this provision, the crime of assault on the police belongs to the perpetrator, that is, it does not need to cause serious harmful consequences, only the act of violence is committed, and the circumstances are serious enough to harm the police, which can be constituted. If firearms and other tools are used to carry out the crime, seriously endangering the personal safety of the police, it is even more necessary to increase the punishment.

In this incident, the son-in-law of the old man simply scratched the police, which may consider the circumstances minor, and will not be considered a crime, but only a public security punishment. However, being able to scratch and injure the police shows that the degree of violence is still relatively high, which inevitably violates the criminal law.

Of course, it is simply a scratch, without causing more than minor injuries, even if it is really prosecuted for criminal responsibility in the future, it should not be too heavy, it may only be a few months, or even a month or two of detention.
