The Provisions on the Liability for Repair, Replacement and Return of Household Automobile Products will be implemented from January 1, 2022
The Provisions on the Responsibility for Repair, Replacement and Return of Household Automobile Products promulgated by the State Administration for Market Regulation will be implemented from January 1, 2022, that is, the latest version of the "Three Guarantees for Automobiles", which clarifies the three-guarantee provisions for the core components of electric vehicles such as power batteries and drive motors for new energy vehicles.
The new three-guarantee policy stipulates that household automobile products can be replaced or returned free of charge if the engine, transmission, power battery, driving drive motor or its main components need to be replaced due to quality problems within 7 days from the date of the validity period of the three guarantees.
Household automobile products from the date of the validity period of the three packages within 60 days or within the mileage of 3000 kilometers (whichever comes first), due to quality problems in the steering system failure, brake system failure, body cracking, fuel leakage or power battery fire, can be replaced or returned free of charge.
In any of the following circumstances during the validity period of the three guarantees, if the consumer chooses to replace the household automobile product or return the product with the car purchase invoice or the three guarantee voucher, the seller shall replace or return the product:
(1) Where repairs have been made twice due to serious safety performance failures, but the faults have not been ruled out or new serious safety performance failures have arisen;
(2) The engine, transmission, power battery, and driving drive motor have been replaced twice due to their quality problems, and they still cannot be used normally;
(3) The same major parts of the engine, transmission, power battery, driving drive motor, steering system, brake system, suspension system, transmission system, pollution control device, and body are replaced twice due to quality problems, and still cannot be used normally;
(4) The cumulative repair time due to quality problems exceeds 30 days, or the cumulative repair time due to the same quality problems exceeds 4 times.
The number of replacements of engines, transmissions, power batteries, and driving drive motors and the number of replacements of their main components is not repeated.
From January 1, 2022, new production passenger cars will be equipped with a car "black box"
According to the requirements of the national standard No. 2 of GB 7258-2017 "Technical Conditions for the Safety of Motor Vehicle Operation", from January 1, 2022, newly produced passenger cars need to be equipped with EDR, that is, Event Data Recorder (automotive black box).
Car black box, also known as car work information recorder, car safety information recorder, it can completely and accurately record the relevant situation of the car driving state, can record the car driving trajectory completely, and reproduce it on the computer through special software.
The Car Black Box is an innovative video recording system that comprehensively records the car data at the time of the accident. When an accident occurs, the G-Sensor built into the car's black box will sense emergency braking, sudden acceleration, sharp turns or sudden collisions, and record the situation 20 seconds before and after the accident. In addition, the car black box can also record voice, location and speed data.
From January 1, 2022, the restriction on foreign ownership in passenger car manufacturing will be lifted
On 27 December, the National Development and Reform Commission and the Ministry of Commerce issued Order No. 47 and Order No. 48, respectively, issuing the Special Administrative Measures for Foreign Investment Access (Negative List) (2021 Edition) and the Special Administrative Measures for Foreign Investment Access in Pilot Free Trade Zones (Negative List) (2021 Edition), which came into effect on 1 January 2022. The Special Administrative Measures for Foreign Investment Access (Negative List) (2020 Edition) and the Special Administrative Measures for Foreign Investment Access in Pilot Free Trade Zones (Negative List) (2020 Edition) shall be abolished at the same time.
In the field of automobile manufacturing, the restriction on foreign ownership in passenger car manufacturing and the restriction that the same foreign company can establish two or fewer joint ventures in China to produce similar vehicle products are abolished.
The 2021 version of the negative list of foreign investment access in the national and pilot free trade zones was further reduced to 31 and 27 articles, with the proportion of reductions being 6.1% and 10% respectively.
As early as 2018, the state said that it would further implement the opening requirements of automobile, shipbuilding, aircraft and other industries on the basis of the basic opening up of the manufacturing industry, and relax the restrictions on foreign ownership, especially in the automotive industry. In 2018, the foreign ownership restrictions on special vehicles and new energy vehicles will be abolished, the foreign ownership restrictions on commercial vehicles will be abolished in 2020, the foreign ownership restrictions on passenger cars will be abolished in 2022, and the restriction on setting up no more than 2 joint ventures in China will be abolished.
