A couple of parents in British Columbia disagreed over whether to vaccinate their children against covid-19, and the father filed a lawsuit with the court to prevent the child from being vaccinated, and the judge recently pronounced a verdict.

Recently, more and more Canadian families have disagreed over whether to vaccinate their children and go to court. Legal professionals caution that anyone, especially parents who oppose vaccination, should raise credible evidence and compelling concerns in court.

In the case, Judge Ted Gouge handed down his verdict last week.

The judge argued that the father, who filed the lawsuit, provided only "his own summary of remarks critical of COVID-19 vaccination" and that the sources of those statements were "people with unknown qualifications." ”

According to court documents, the mother, based on the advice of her family doctor, offered to vaccinate her 10-year-old daughter against COVID-19.

Judge Gouge noted that he also referred to guidance from the B.C. Department of Public Health at his trial, which said vaccinations were "safe and effective" ways to protect children from serious consequences after contracting COVID-19.

"When you vaccinate your children, you can protect them from severe COVID-19 and reduce the chances of spreading the infection within the community," the provincial government website reads.

Canadian courts have previously heard cases involving COVID-19 vaccine controversies. In September last year, the Ontario High Court ruled on a similar case. At the time, the judge said, "Public health agencies are better able than courts to judge the health benefits and risks that COVID-19 vaccination will bring to children." ”

"In contrast, the opposing side lacks convincing evidence." In his ruling on the case, Judge Doge said, "Getting eligible children vaccinated can bring the greatest benefits." ”

Before the trial, Gouge also asked the parents to consult with a public health nurse, who also recommended that their children be vaccinated.

But the child's father still insisted on his views and took the matter to the family court, hoping that the court would issue an injunction to prevent his daughter from being taken to be vaccinated. But Judge Doge said in his final verdict in the case that it was up to the child's mother to decide whether to vaccinate the child, when to go and how to get it.

The judge also noted that while awaiting trial, the daughter contracted the coronavirus and her mother was subsequently diagnosed. The child was asymptomatic, but her mother felt unwell.
