After calling the police, it was found that it had been stolen by a 12-year-old boy he did not know. When the police found the boy, they were told that they had spent all the money, not only bought game cards and toys, but also invited their classmates to dinner.
The boy's parents are divorced, and the boy lives with his father and stepmother. When he contacted the boy's father, he said that he could not control the child and had no money to compensate. Finally, a piece of bacon was brought to the door to apologize. The woman's family had to admit that they were unlucky and ate the bacon with tears. Since the boy was only 12 years old, the police only educated him critically.
As the saying goes, "steal needles when you are young, steal gold when you grow up". The young man actually stole 6,000 yuan from someone else, which is undoubtedly a huge amount of money for a child. But the boy spent it with ease, eating, drinking and consuming. Although the divorce of the boy's parents is indeed pitiful, the father, as the guardian, should fulfill the educational and supervisory responsibilities. The boy's theft is not only uncultured, but also a naked violation of the law and even a crime.
The crime of theft provided for in the Criminal Law of the Mainland refers to the theft of public or private property in a relatively large amount or multiple thefts, burglaries, theft with murder weapons, and pickpocketing of public or private property for the purpose of illegal possession.
The crime of theft is an offence of an amount of money, so the amount of proceeds of theft by the perpetrator should be fully taken into account in sentencing. According to the judicial interpretation of the SPC, the theft of public and private property worth more than 1,000 yuan to 3,000 yuan is a "relatively large amount" and can generally be punished by imprisonment of not more than 3 years.
However, the age of criminal responsibility for the offence was 16 years, and although the boy had committed theft, he was not criminally liable because he had only been 12 years old at the time of the offence. However, their parents or other guardians may be ordered to discipline them; when necessary, special corrections and education may be conducted in accordance with law.
At the same time, according to article 1188 of the Civil Code, if a person without capacity for civil conduct or a person with limited capacity for civil conduct causes damage to others, the guardian shall bear tort liability. In this case, the boy's father was the legal guardian, and the boy's father should bear the liability for compensation for the property damage caused by the boy's behavior.
But when the boy's father learned that the boy had stolen and squandered 6,000 yuan, he wanted to get rid of the responsibility with a cold "can't manage it", which was really chilling. Although a piece of bacon was sent afterwards to show compensation, the value of this piece of bacon was far less than the loss, and the victim could refuse and demand compensation according to the loss. But in the end, the woman and her family considered themselves unlucky and chose to accept bacon compensation.
