On strengthening the management of cultural relics collected by the people

Opinions on promoting the orderly development of the cultural relics market

All provinces, autonomous regions, municipalities directly under the Central Government, cultural relics bureaus of the Xinjiang Production and Construction Corps, development and reform commissions, human resources and social security departments (bureaus), departments of commerce (bureaus, committees), departments of culture and tourism (bureaus), market supervision bureaus (committees, departments):

In order to implement the "Several Opinions on Strengthening the Reform of the Protection and Utilization of Cultural Relics" and the "14th Five-Year Plan" for the Protection and Scientific and Technological Innovation of Cultural Relics issued by the General Office of the CPC Central Committee and the General Office of the State Council, the following opinions are hereby put forward on strengthening the management of cultural relics collected by the people and promoting the orderly development of the cultural relics market.

1. Standardize appraisal. Establish a normal mechanism for public interest consultation on cultural relics appraisal, encourage qualified state-owned museums, state-owned cultural relics stores, and appraisal institutions for cultural relics involved in cases to provide public welfare consulting services to the society, and popularize the knowledge of cultural relics collection and appreciation. Explore the establishment of a national cultural relics appraisal and appraisal management system, carry out the qualification management of cultural relics appraisal institutions on a pilot basis, standardize the operational activities of cultural relics appraisal, and provide convenient services for the orderly circulation of cultural relics collected by the people.

2. Strengthen protection. Increase the publicity and application of theories, methods and technologies of cultural relics protection, promote advanced concepts and technical standards for the preservation and restoration of cultural relics in the collection, and improve the level of protection of cultural relics in folk collections. Support state-owned cultural and cultural institutions with the capacity to give full play to their own advantages, provide technical services such as storage and restoration for collectors of civil cultural relics, and encourage social forces to establish commercial institutions for the preservation and restoration of cultural relics.

Third, encourage use. Under the premise of ensuring the authenticity and legality of cultural relics, public cultural facilities such as museums, libraries, and art galleries are encouraged to hold exhibitions for folk collections of cultural relics. Support collectors of folk cultural relics to open non-state-owned museums, and encourage the authorized use of cultural relics resources in folk collections and the development of derivative products. Complete the implementation of the reward system and preferential tax policies for donating non-governmental collections of cultural relics to state-owned cultural relics collection units, allowing facilities such as buildings to be named with the names and names of donors, and absorbing donors to participate in the legal person governance of public cultural institutions.

Fourth, guide the collection. Implement the project of publicizing and popularizing the knowledge of cultural relics collection appreciation, strengthen the supervision of publications, audio-visual programs and network information on the appraisal of cultural relics collections, guide the people to establish a correct view of cultural relics collection, and refuse to illegally trade cultural relics. Guide the whole society to excavate, interpret and publicize the cultural value of folk collection of cultural relics, cultivate a healthy and rational collection group, stimulate collection demand, and create a rational collection atmosphere.

5. Guarantee circulation. Clarify the conditions for the circulation of cultural relics into the market, strengthen transaction risk tips, enrich and improve the database of stolen (lost) cultural relics in China, issue market warning catalogues for stolen (lost) cultural relics information cases, guiding standards for the identification of prohibited cultural relics, and other policy guidelines, and guide private cultural relics collectors and cultural relics business entities to legally trade cultural relics. Explore the establishment of a registration and trading system for cultural relics collected by the people, and for cultural relics voluntarily declared by cultural relics business entities, which are not within the scope of prohibited trade in cultural relics, they may enter the market after registration with the professional institutions designated by the relevant administrative departments for cultural relics.

Sixth, enrich the supply. Simplify the procedures for reviewing the auction targets of cultural relics such as calligraphy and paintings, ancient books, inscriptions, furniture, and ethnic and folk cultural relics with heirlooms as the main body. Strengthen the recognition and interpretation of the value of modern and contemporary cultural relics, and increase the effective supply of the market. Increase the development of cultural and creative products, and promote the circulation of related cultural relics and artworks. Guide relevant institutions to regularly publish information guidelines such as transaction statistics and trend analysis of the cultural relics market, guide market expectations, and activate the supply of relevant sub-segments of the market.

7. Promote reflux. Carry out the registration of cultural relics into the country on a pilot basis, actively study and adjust the tax policy for promoting the return of overseas cultural relics, optimize the management of the temporary entry and exit of cultural relics and trade facilitation services, give play to the advantages of the pilot free trade zone, the comprehensive pilot demonstration of the expansion and opening up of the national service industry, the comprehensive bonded zone, the import expo and other key platforms, and guide and encourage the return of overseas cultural relics and provide public welfare services such as exhibitions to the society.

VIII. Strictly control loss. Strengthen the construction of national cultural relics entry and exit examination institutions, improve the national standard system for the review of the export of cultural relics of various types, prevent the loss of cultural relics, and ensure the supply of domestic cultural relics market. Docking international conventions and relevant laws of countries of origin of cultural relics, improving the management system for the entry and operation of foreign cultural relics, and regulating the channels for the entry of foreign legal cultural relics.

9. Optimize purchase and sale. Explore lowering the threshold for the entry of cultural relics stores, optimize the requirements for the establishment of cultural relics stores in terms of registered capital and professional personnel, and pilot the inclusion of merchants involved in cultural relics business in the antique and flea markets that meet the conditions into the management of cultural relics stores. Support the gradual reform and transformation of state-owned backbone cultural relics stores, and cultivate the formation of large-scale cultural relics circulation enterprises. Strengthen the role of cultural relics stores as the main channel of the primary market, encourage cultural relics stores to expand related businesses, accelerate quality improvement and upgrading, and explore chain operations.

10. Strengthen the auction. Guide cultural relics auction enterprises to do a good job in structural adjustment, and through standardized operations, promote the formation of a number of leading cultural relics auction enterprises with high market reputation, large operating scale and strong service functions in competition. Encourage cultural relics auction enterprises to expand their service fields and service content, and engage in personalized services such as intermediary consultation, entrustment and custody, and leasing display. Support qualified cultural relics auction enterprises to "go global" and create Chinese cultural relics auction brands with international recognition and influence.

11. Innovative business formats. Support cultural relics business entities to develop modern circulation management methods such as e-commerce, and cultivate new formats such as online display, trading, and customized services. Further implement the main responsibilities of e-commerce platforms and business entities within the platform, and strengthen the supervision and management of cultural relics network business activities. Support cultural relics business entities to extend the industrial chain to engage in logistics, warehousing, display, insurance and other related businesses. Explore the establishment of a financial service model for cultural relics operations, and guide and regulate capital to participate in the innovative development of the cultural relics market. Promote the aggregation and integrated development of related formats such as circulation operation and appraisal appreciation, professional training, display and exchange, creative life, and cultural tourism.

12. Policy support. Promote the implementation of relevant preferential policies for cultural relics business entities to enjoy supporting the development of modern service industries, small and medium-sized enterprises, and cultural enterprises. Formulate and improve the management system related to the circulation, operation and appraisal of cultural relics, improve various support policies such as encouraging the donation of cultural relics, promoting the return of cultural relics, supporting business innovation, and cultivating professional talents. Support the formulation of local and enterprise standards, and accelerate the formulation and revision of management and service standards for cultural relics appraisal, price assessment, market transactions, and transportation insurance.

13. Talent training. Support the professional and technical personnel of cultural relics business entities to participate in the evaluation of the professional titles of cultural relics museums. Improve the professional qualification management system for cultural relics protection engineering personnel, and standardize the practice of cultural relics appraisal. Rely on state-owned museums and other cultural and museum units to increase the practice of cultural relics appraisal, and carry out the identification of the occupational skill level of cultural relics protection personnel. Give full play to the respective advantages of industry associations and platform bases, and promote industry-university-research cooperation to cultivate high-end talents in cultural relics operation and management.

14. Joint supervision. Innovate and strengthen supervision during and after the event, and build a new type of supervision mechanism with "double random and one open" supervision as the basic means, risk monitoring and disposal as a supplement, and credit supervision as the basis. Improve the administrative departments for cultural relics to guide, supervise, and support the operation mechanism for law enforcement in the cultural relics market that guarantees the comprehensive law enforcement team of the cultural market, improve the law enforcement coordination mechanism in the field of cultural relics circulation in which the administrative departments for cultural relics and market supervision departments are responsible for the division of labor and closely cooperate, and investigate and deal with illegal activities in accordance with law. Accelerate the establishment of a credit system and long-term mechanisms in the field of cultural relics circulation covering cultural relics business entities, employees, collection groups, appraisal institutions, and affiliated enterprises, and create a fair and honest social environment for the circulation of cultural relics.

15. Departmental coordination. Promote the establishment of cross-departmental cooperation mechanisms such as cultural relics and development reform, human resources and social security, commerce, culture and tourism, and market supervision, strengthen policy coordination and regulatory linkage, improve the top-level design and policy measures to promote the protection and utilization of cultural relics in private collections, and standardize the management of the cultural relics market, and timely carry out supervision, guidance, supervision and inspection. Give play to the positive role of industry associations in talent training and evaluation, protecting the rights and interests of enterprises, strengthening industry self-discipline, assisting government supervision, etc., to protect the legitimate rights and interests of private cultural relics collectors, and to promote the active and orderly development of the cultural relics market.
