In the end, the female owners united with 500 owners to write a joint letter of opposition, and successfully stopped the construction of the base station. However, before the large troops began to taste the joy of success, the owners found the mobile phone, no! letter! number! finish! So the female owner took everyone crazy complaints.
This can provoke the construction party, build and not build, and keep complaining, how can this be done? But the owners didn't care about this, their requirement was not to build the base station on the roof of their Building 4, but also to ensure that the signal had to be there.
The owner's seemingly unreasonable request is actually nothing wrong, her request is legal and reasonable.
According to article 46 of the Telecommunications Regulations, basic telecommunications business operators may attach telecommunications lines to civil buildings or set up public telecommunications facilities such as small antennas and mobile communication base stations, but shall notify the owner or user of the building in advance and pay royalties to the owner of the building or other right holders in accordance with local standards.
From the above provisions, we can see that in order to build a base station in a residential building, it is first necessary to obtain the consent of the owner or user of the building, that is, the owner, and after the construction, the owner must pay the use fee. But now the construction party only communicated with the property and did not notify the owner of the building, so this violates the provisions of the Telecommunications Ordinance, and the owners can ask to stop the construction.
So why did the construction party have to build the base station on this residential building? And does the radiation of the base station affect health?
In fact, there was a large base station near the community before, but because of the demolition, it was demolished, and now the construction party has found that the roof of the building where the female owner lives is the best place to build the base station. But they did not communicate with the owner, but just talked to the property and began to build, so there was such a thing.
That base station is definitely radiating. But this radiation is much smaller than the radiation when our mobile phones are talking, and the construction of base stations must be approved by the provincial environmental protection department. Therefore, residents do not have to worry about the life and health hazards that the base station will cause to the residents when it is built on the roof.
Finally, at the insistence of the owners, the base station construction party said that it would demolish the built base station, relocate the site, and try to let the owners of the community have both "fish" and "bear paw".
In fact, this is a small matter, the construction party in advance to communicate with the owner on the line, but they directly found the property, is the property rights greater than the owner? It is important to remember that the property is only a steward and has no right to make decisions on the change of some major matters on behalf of the owner. It seems that these base station construction companies are going to train their employees, at least so that they understand that there is something to communicate with the owner.
