On August 4, 2018, the Xingtai Municipal Public Security Bureau transferred the case to the Xingtai Municipal People's Procuratorate on suspicion of intentional homicide for review and prosecution, but was returned by the procuratorate. On October 19, 2018, the case was transferred by the public security organs to the procuratorate for review and prosecution for the second time. However, prosecutors still disagree on the conclusions of the public security department's investigation.
They believe that in the case of a life hanging in the balance at that time, requiring Dong Mingang to accurately grasp the necessary limits of defense is a bit unobjective and should be considered according to the environment in which the parties are located.
Subsequently, the procuratorate received an important piece of evidence.
On November 28, 2018, the Prosecutor General received a special letter. The letter writer is Dong Mingang's mother, which details Diao Yishui's evil deeds in the past two years, and Dong Chenggang has been humiliated in order to save his family. Dong's mother requested leniency in the law, and the complaint won the joint support of 976 villagers.
On December 4, 2018, the procuratorate once again returned the case to the public security organs for supplementary investigation, hoping that the public security department would verify the contents of the letter clearly, and asked the public security department to verify the cause of the wound on Diao Yishui's body.
After appraisal, the wounds on Diao Yishui's body were of different sizes and shades, and the arrangement was irregular, and the public security department believed that when the two were wrestling, Dong Mingang was stabbed indiscriminately. And Diao Yishui's crime tool is the car key, which is not enough to cause death.
On January 3, 2019, the public security organs terminated the supplementary investigation, maintained the previous conclusion, and transferred the case to the procuratorate on suspicion of intentional homicide and constituting excessive defense!
According to the laws of our country, supplementary investigation is limited to two times! And both times the public security organs believe that he is suspected of intentional homicide, is this the case so characterized? Not!
The procuratorate believes that in the two supplementary investigations, the direction of the public security organs is mainly in the process of committing the crime, but the antecedent facts of the case and the subjective mentality of the suspect also play an important role in the case.
Therefore, in order to maintain the fairness and impartiality of the law, the procuratorate decided to initiate its own supplementary investigation procedures. This also completely changed the fate of Dong Mingang!
In order to better understand the truth, the prosecutors came to the village of the two men.
