Article 258 of the Criminal Law of the Mainland stipulates: "Whoever has a spouse and is bigamous, or who knowingly resides with another person in the name of husband and wife, shall be sentenced to fixed-term imprisonment of not more than two years or criminal detention." ”

3. Cohabitation with a military married person

The first paragraph of article 259 of the Criminal Law of the People's Republic of China stipulates: "Whoever knowingly resides with or marries the spouse of an active military member shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention." ”

It is illegal for a person to live with a third person, whether it is a military member or a spouse, in which case even the illegal cohabitant is sentenced to prison without having to live as a husband and wife.

Whoever, by taking advantage of his or her powers or subordinate relationship, rapes the wife of a serviceman on active duty by means of coercion shall be convicted and punished in accordance with the provisions of Article 236 of this Law. That is to say, at this time, the illegal cohabitant commits the crime of sabotaging military marriage and can be sentenced to fixed-term imprisonment of not less than three years but not more than seven years or criminal detention.
