New regulations on annual review of motor vehicles

This year, the Ministry of Public Security made new regulations on the annual inspection of vehicles in 2021, compared with the previous annual inspection regulations, the new regulations have been adjusted in some details, and will be implemented on January 1, 2021. According to the "Motor Vehicle Safety Technical Inspection Items and Methods", the new annual inspection regulations are divided into two parts: private cars and freight cars, as follows:

In terms of private cars, first of all, a link was added to the annual inspection project - "safety defect recall" link, if the car has a safety problem, the manufacturer is recalling, then the staff will remind the owner of the car recall through big data.

Secondly, the new annual inspection regulations clarify and relax the audit restrictions on the appearance of the car, stipulating that the car is allowed to have personalized changes in the net, pedal, luggage rack, bumper, and wheel hub during the appearance inspection.

In terms of freight vehicles, the new regulations implement three increases and six subtraction measures, that is, the new tire pattern depth, wheel lifting device, wheelbase three new items to detect; delete noise, speedometer, suspension efficiency, economy, power, front light offset 6 old items.

In addition, the new annual inspection regulations also make adjustments to the annual inspection cycle and the scope of exemption. First of all, the scope of exemption from motor vehicles has been expanded from less than or equal to 6 seats within 6 years to non-operating small and micro passenger cars with 7-9 seats. In other words, 7-9 non-operating small and micro passenger cars under 6 years will be able to enjoy the exemption policy.

Secondly, the first 6 years of the exemption of the car can be exempted from the on-line testing, but every two years to go through the formalities, 6-10 years for the annual inspection. That is to say, the inspection-free cars are inspected every two years in 10 years, but only the sixth and eighth years need to be tested online.

Auto "New Three Guarantees" policy

From January 1, 2021, the state began to implement the new "three guarantees" policy. In this policy, this restriction will be abolished, that is, consumers who carry out independent maintenance outside the authorized 4S stores of automobile manufacturers will also enjoy the "three guarantees" policy.

This article is equivalent to clarifying that the reasonable maintenance and repair of consumers can be carried out outside the 4S shop designated by the manufacturer, and the manufacturer and the dealer cannot refuse the reasonable three guarantees of rights and interests of the consumer on the grounds of "not maintaining and repairing in the 4S shop", which is a double benefit for the terminal owner and the social third-party repair shop!

Previously, consumers who did not do maintenance in the 4S shop during the car warranty period were regarded as delearning behavior, and in the "new three guarantees" of the car, it was changed to "the operator shall not restrict the consumer from independently choosing the enterprise for the maintenance and maintenance of household automobile products, and take it as the reason for refusing to bear the responsibility of the three guarantees." ”

In addition, the "new three guarantees" also emphasizes the rights and interests of a "7-day return and replacement", that is, within 7 days from the date of the validity period of the three guarantees, if the engine, transmission, power battery, driving drive motor or its main parts need to be replaced due to quality problems, consumers can choose to replace the household car products or return the home car products with the car purchase invoice and the three-pack voucher, and the seller should replace or return the goods free of charge.

Of course, pure imported cars are also included in the scope of the three guarantees, in the past, imported car owners can not enjoy the treatment of three guarantees, we can also pay attention to it.

Exclusive commercial insurance clauses for new energy vehicles

This summer, the China Insurance Industry Association issued a blockbuster regulation, the "China Insurance Industry Association New Energy Vehicle Commercial Insurance Exclusive Clauses (2021 Edition of The Draft for Comment)".

Not long ago, the China Insurance Industry Association officially issued the "Exclusive Clauses for Commercial Insurance of New Energy Vehicles (Trial)", and the "three electricities" (batteries and energy storage systems, motors and drive systems, and other control systems) of new energy vehicles that have attracted much attention are included in the scope of protection, covering the use scenarios of new energy vehicles driving, parking, charging and operation.

At the same time, the "Clauses" combine the characteristics of charging new energy vehicles to develop the "Self-use Charging Pile Loss Insurance" and "Self-use Charging Pile Liability Insurance", which not only covers the loss of the vehicle, but also includes the loss of auxiliary equipment such as charging piles and the property losses and personal injuries that may be caused by the equipment itself; and concentrates on solving the risks caused by auxiliary facilities in the application of new technologies. This is the first time that auto insurance has underwritten external fixed auxiliary equipment, which is an innovation and exploration in the field of auto insurance.

This regulation mainly elaborates the content of new energy vehicle insurance, and clarifies the scope, insurance types and purchase methods of the main insurance. Among them, the public solicitation of opinions this time not only includes the three-electric system that consumers are most concerned about into the scope of protection, but also includes spontaneous combustion, power grid failure, charging piles, intelligent auxiliary driving software, etc., but it clearly states that battery attenuation is not insured!

New Regulations on the Administration of Pollution Discharge Permits

On March 1 this year, State Council Decree No. 736 issued by the State Council, the Regulations on the Administration of Pollution Discharge Permits (hereinafter referred to as the "Regulations"), has been formally implemented. The biggest highlight of the promulgation and landing of the "Regulations" is that the main responsibility of the polluting unit has made clear requirements.

For example, polluting units should operate and maintain pollution prevention and control facilities in accordance with the requirements of ecological environment management, build standardized pollutant discharge outlets, carry out self-monitoring and save original monitoring records in accordance with the law, and key management of polluting units need to be networked with the monitoring equipment of the competent ecological and environmental departments, and the original monitoring records and environmental management ledgers shall not be less than 5 years.

"The discharge permit is not only a 'pollutant discharge qualification certificate', but also a carrier of legal and normative requirements for pollutant discharge. The pollutant discharge permit is a legal document that the polluting unit undertakes the obligation and responsibility for pollution discharge control, which is statutory and mandatory. Sun Shouliang, director of the Environmental and Economic Policy Research Center of the Ministry of Ecology and Environment, said that the regulations return the responsibility for pollutant emission control to enterprises, change the previous practice of government packaged and nanny management, and clarify the main responsibility for pollutant discharge control of polluting units.

In terms of legal liability for illegal discharge, the regulations are strictly stipulated. For example, for acts such as discharging pollutants without a license, the competent department of ecology and environment shall order corrections or order the restriction of production, suspension of production and rectification, and impose a fine of between 200,000 and 1 million yuan; if the circumstances are serious, report to the people's government with the right to approve and order the suspension or closure of business.

If the polluting unit refuses to cooperate with the supervision and inspection of the competent department of ecology and environment or cheats while accepting supervision and inspection, it will be fined between 20,000 yuan and 200,000 yuan.

Overall, these new policies in the interests of the country and the people at the same time, but also improve the access threshold of the automotive aftermarket, for some independent aftermarket store owners, operating costs will increase, the corresponding service pricing may also increase.
