From tomorrow, the Ministry of Public Security's newly formulated "Measures for the Administration of Scoring of Road Traffic Safety Violations" will be implemented. In order to further improve the management of scoring for road traffic violations, the Ministry of Public Security separately formulated new scoring methods, adhered to the principle of blending leniency with severity, and strengthened education and guidance, and systematically adjusted the current scoring management system on the mainland.
In general, after optimizing the adjustment of the score adjustment, there are 5 ladders such as 12 points, 9 points, 6 points, 3 points, and 1 point. A new scoring type of 9 points has been added, and a scoring type of 2 points has been deleted.
Second, in accordance with the principle of combining leniency and severity, the scoring value and scoring items are adjusted as a whole. According to the harm of traffic violations to traffic safety, the scores of 24 illegal scores remain unchanged, the scores of 20 scoring acts were reduced, 11 scoring acts were deleted, and the scoring values of 5 scoring acts were raised, and the scoring behaviors were reduced from the original 52 to 50.
Compared with the previous regulations, this adjustment has many new changes that drivers have ignored, and some new measures that are helpful to promote traffic civilization are worth noting, mainly reflected in the following aspects.
The speed penalty score is reduced
First of all, the two categories of high-speed or urban expressways and ordinary roads are distinguished for the speeding road range. The speed of 50% or more on high-speed or urban expressways remains unchanged for 12 points, while the normal road is modified to 6 points; the same is modified to 3 points for ordinary roads in the range of 20-50% of the speed. Speeding below 20% is non-deductible for all road ranges.
It is worth mentioning that speeding below 20% does not deduct points, does not mean that it is not illegal. According to Article 42 of the Mainland Road Traffic Safety Law, motor vehicles driving on the road shall not exceed the maximum speed indicated by the speed limit sign. In sections of the road without speed limit signs, safe speed should be maintained.
Therefore, the newly revised illegal scoring regulations do not mean that the law allows the speed limit of 144 km/h to be driven on highways with a speed limit of 120 km/h. According to Article 90 of the Road Traffic Safety Law, if a motor vehicle driver violates the provisions of road traffic safety laws and regulations on road traffic, he shall be given a warning or a fine of not less than 200 yuan but not more than 200 yuan. Where this Law provides otherwise, punishment shall be given in accordance with the provisions.
Therefore, what kind of punishment will be imposed for speeding below 20%, and it must be handled in accordance with the specific penalty standards and rules and procedures of the traffic police. Keep in mind that driving safely is the most basic and important core requirement.
Set 9 points for the buffer period
In this adjustment, the point penalty has been increased by 9 points and some illegal acts that were originally 12 points at a time have been changed to 9 points. For example, driving a motor vehicle that does not hang a motor vehicle number plate or deliberately obscuring or defacing the number plate of a motor vehicle on the road; driving a motor vehicle that does not match the type of quasi-driving vehicle; and driving a school bus without obtaining a school bus driving qualification.
In this regard, it is mainly considered that the above-mentioned illegal acts and the illegal acts such as drunk driving, fleeing after causing casualties in traffic accidents, etc., which are still worth 12 points at a time, have some differences in terms of traffic safety and social impact, and the circumstances have not reached a very bad level, and the impact is relatively small.
In order to achieve the punishment and educational effect for drivers, the punishment for some illegal acts is set to 9 points at a time, leaving a buffer period to warn them that their scores are about to reach full points, improve the awareness of road traffic safety and civilization, and urge them to drive safely and civilly.
The emphasis is on promoting traffic civilization
The biggest highlight of this adjustment of the scoring method is aimed at playing a positive role in promoting the construction of transportation civilization. Punishment is not the goal, civilized driving is the essential requirement, through punishment to let every driver in the daily driving to develop better civilized driving habits, change some of the previous bad habits.
For example, if you encounter a queue in front of you or a traffic jam, if you overtake or maliciously add congestion through the road, the penalty will be increased from 2 points to 3 points; the number of points for answering or making calls by car will be increased from the original 2 points to 3 points. In addition, illegal parking on highways or urban expressways has increased from the original 6 points to 9 points.
For the "turtle speed car" behavior that many drivers hate, this time also added a new penalty clause, the specific penalties are as follows: driving on the highway below the prescribed minimum speed, 3 points are deducted at a time. Presumably, this regulation has also been approved by many people, if the behavior of "turtle speed car" can not be effectively governed, perhaps it should also increase the intensity of punishment.
Heavy penalties for selling points, and deduction of points for studying the law
The new rules also impose severe penalties for buying and selling points, and those who accept penalties for traffic violations and demerit points in lieu of actual motor vehicle drivers for economic gain will be directly deducted 12 points.
In addition to the penalty on the score, a fine will be imposed. For drivers who buy and sell points, the traffic management department of the public security organ shall pay a fine of not more than three times the economic benefits, up to a maximum of 50,000 yuan. For those who organize others to buy and sell for economic benefits, the traffic management department of the public security organ shall impose a fine of not more than five times the illegal income, up to a maximum of 100,000 yuan.
The new regulations will also implement the measures to reduce points for studying the law throughout the country. Before the demerit points reach the full score, the driver of a motor vehicle may apply for a deduction of points from the existing accumulated demerit points by participating in the traffic safety education organized by the traffic management department of the public security organ, and the maximum deduction of 6 points in a scoring cycle can be deducted.
The conditions for accepting applications for traffic safety education to deduct points for traffic violations are: First, the driver of the motor vehicle must meet the cumulative illegal demerit points of less than 12 points in the current cycle, and the score of the deduction of points that have participated in the study of the law in this cycle is less than 6 points. However, not all drivers are eligible to participate in the deduction of points.
The methods of receiving traffic safety education include participating in three types: participating in the road traffic safety online learning examination organized by the traffic management department of the public security organ, the on-site study examination and the traffic safety public welfare activities. For those who have scored 12 points multiple times in a scoring cycle, the study time will be extended, the learning content will be increased, the examination subjects will be increased, and the education management of drivers who have repeatedly violated the law will be strengthened.
Convenient new measures, C6 online
It is worth mentioning that also implemented on April 1 is the newly revised "Regulations on the Application and Use of Motor Vehicle Driving Licenses" by the Ministry of Public Security. The newly revised departmental regulations have introduced 6 new measures to facilitate the convenience of the people and enterprises, including 4 new measures to facilitate the issuance of driving tests and 2 new measures to reduce the number of convenient services.
According to the new measures, there are also some changes in driving test licensing. For those who apply for a driving license for large and medium-sized passenger and freight vehicles outside the place of household registration, the applicant can use the resident identity card to "pass the examination with one card", and there is no need to submit a residence certificate. Second, the driving qualification examination was resumed "inter-provincially". Third, for those who hold a small automatic car driving license to drive other small cars, or hold a motorcycle driving license to drive other types of motorcycles, only test subjects two and three, and optimize the examination procedure.
Another important change is the addition of a light traction trailer quasi-driving type, with small and micro passenger car C1, C2 driver's license driver, by applying for C6 driver's license to increase driving and driving training, family cars can take the road trailer motorhome on the road. C6 driver's license can not be obtained directly, can only be obtained through "additional driving", the content of the test is subject two and subject three.
