Lincoln car has a maintenance record before selling the car, can the owner get a "refund of one loss of three"?

■Press:

Lincoln cars have maintenance records before selling the car, and the owner questions the 4S shop for concealing the condition of the car

The vehicle had a maintenance record before buying the car, which was a bad thing that Mr. Lincoln Car Director encountered.

Recently, Mr. Ren told Consumer Report that the Lincoln Continental car he purchased had maintenance records such as paint repair before the purchase of the car, and Mr. Ren questioned the 4S store to conceal the condition of the car and sold the accident vehicle to himself.

So, why does Mr. Ren's vehicle have a maintenance record before it is sold? Does the 4S store really hide the car from consumers? Is Mr. Ren's experience satisfied with "one refund and three losses"? Consumer Report conducted an interview on this.

"I spent so much money on an imported car, I didn't expect such a problem." Mr. Ren said in an interview with Consumer Report.

In June 2020, Mr. Ren purchased a Lincoln Continental at an official Lincoln 4S store in Beijing. Mr. Ren, who was happy to mention the new car, was unexpected about the problems in this car.

According to Mr. Ren, after the purchase of this car, there have been problems such as chassis noise, instrument cracking, and cracking of the center console. "I don't know if it's just my car that has so many problems, I slowly started to question the quality and quality control of the vehicle." Mr. Ren said.

With doubts, Mr. Ren went to the Lincoln 4S store where the car was purchased to check all the maintenance records of the vehicle, and found that the vehicle had repair records such as paint repair before he bought the car.

The vehicle maintenance records provided by Mr. Ren show that on April 18, 2020, Mr. Lin's vehicle had a maintenance record at the 4S shop involved, and the maintenance matter was "paint on the front bar scratch", and the maintenance type belonged to "sheet metal spray".

"Consumer Report" found that the owner column in the maintenance record was displayed as "4S shop", and the repairman was not Mr. Ren. Consumer Reports compared the information provided by Mr. Ren with the vehicle information in the above maintenance records and found that the frame numbers of the two were consistent.

The condition of the vehicle became the focus of controversy

It was found that the vehicle had maintenance records before the sale, and Mr. Ren questioned the condition of the car. "I bought a new car, and there shouldn't have been a repair before the vehicle was sold to me." Mr. Ren said.

In addition, Mr. Ren said that the 4S store did not truthfully inform him of the vehicle status. "The 4S shop never told me that the vehicle had been repaired before buying the car, never said that there was a problem with the vehicle, and assured me that it would not sell the problematic car."

For the interpretation of the relevant maintenance records, according to Mr. Ren, the 4S shop changed its statement many times. "During the on-site negotiations, the 4S shop first did not admit that the vehicle had been repaired, then said that the maintenance records of other cars were wrongly registered in my car, and finally said that it was only repainted, there was no sheet metal spray paint."

In Mr. Ren's view, the maintenance records provided by the 4S shop are enough to show that the vehicle does have traces of repair. "I think whether the vehicle has been repaired, what reason for repair, these should not be a confused account, can Lincoln cars change or delete maintenance records at will, and can the vehicle be repaired and denied?"

To this end, in response to mr. Ren's problems, Consumer Reports contacted the Lincoln 4S store where he bought the car, and an after-sales service staff member said that he would give feedback to the leader on the relevant situation and would respond, but as of press time, Consumer Report had not received a detailed reply.

At the same time, Consumer Reports also sent an interview letter to Lincoln China, but had not received a reply as of press time.

Guo Xiaoming, a lawyer at Shanghai Zhonglian (Chengdu) Law Firm, a well-known legal blogger @ Tandian, pointed out that if the Lincoln 4S store involved deliberately concealed the problem of vehicle defects when selling cars, it may constitute fraud, and consumers have the right to claim "one refund and three losses".

Guo Xiaoming suggested that consumers should pay special attention to the condition of the vehicle when buying a car. "When consumers buy a car, they should pay attention to the commitment and explanation of 4S stores and manufacturers on the performance and quality of the vehicle, save the relevant promotional materials, and the content promised by the sales staff can be required to be reflected in the contract." In addition, when delivering the vehicle, the car should be accepted, and the 4S shop is required to issue a relevant test report and a certificate of conformity. After purchasing a car, if you find that there is a problem with the vehicle, you should contact the 4S shop in time to deal with it. ”

As a second-tier luxury brand, Lincoln has been surviving in the fierce competition. Lincoln brand data shows that full-year sales in 2021 were 91,621 units, an increase of 48% year-on-year, of which the annual sales of the new Lincoln Adventurer models exceeded 50,000 for the first time. At present, Lincoln has three models to achieve domestic production.

However, behind the high sales, the quality control problems of Lincoln models also need to be paid attention to, including some Lincoln owners who reflect the low-frequency resonance problem in the carriage when driving. To enter the first line of luxury, Lincoln still needs to do a lot.

Consumer Report will continue to follow the latest developments in the Lincoln car owner rights protection incident mentioned above.
