Since children are legally characterized as non-civil liability (under 8 years of age) or limited civil liability (under 16 years of age), they are mainly pursued for civil liability. According to Article 1188 of the Civil Code, if a person without capacity for civil conduct or a person with limited capacity for civil conduct causes harm to others, the guardian shall bear tort liability.
