Unauthorized commercial use of the Olympic symbol BMW was fined 50,000

According to the National Enterprise Credit Information Publicity System, BMW (China) Automobile Trading Co., Ltd. was fined 50,000 yuan by the Chaoyang District Market Supervision and Administration Bureau of Beijing Municipality for violating the second paragraph of Article 4 of the Regulations on the Protection of Olympic Symbols (2018).

From July 23 to August 8, 2021, BMW (China) AutoMotive Trading Co., Ltd. published 10 promotional microblogs with words such as "#Watching the Olympic Games# on the Weibo account of the company's real-name authentication" with posters. Although the parties BMW Company stated that the copy and poster were designed, produced and published by Meituo Technology (Beijing) Co., Ltd., and that the hot search term "#Watching the Olympic Games" was authorized to be used after communicating with Sina Weibo by the Beijing Branch of the company's media procurement agency, Shanghai Leo Bena Co., Ltd., after communicating with Sina Weibo, the right holder of the Olympic symbol, confirmed by the letter from the Organizing Committee of the Beijing 2022 Winter Olympic and Paralympic Games that the party concerned had not obtained the authorization to use the Olympic Symbol for commercial purposes. The parties concerned did not use this publicity to obtain relevant economic benefits, so it was determined that there was no illegal business turnover.

BMW (China) Automobile Trading Co., Ltd. (hereinafter referred to as BMW) was fined 50,000 yuan for the commercial Olympic symbol.
