Automobiles are closely related to our lives, and on January 1, 2022, the new version of the "three guarantees for automobiles" national regulations will be implemented. This is a decade later, the "three guarantees for automobiles" national regulations have been revised and promulgated again. The new regulations have greatly improved in terms of protecting consumer rights and practicability.

Today, we specially invited Wang Ying, an auto expert from the Consumer Protection Commission of Zhejiang Province, to interpret the new version of the "three guarantees for automobiles" national regulations.

The "Provisions on the Responsibility for Repair and Replacement of Household Automobile Products" implemented in January 1, 2022, referred to as the new version of the "Three Guarantees for Automobiles" national regulations.

Returns and exchanges are divided into three periods:

The first period is within 7 days;

The second period is 60 days or less than 3000 km (whichever comes first);

The third period is 2 years or less than 50,000 kilometers (whichever comes first).

Return and exchange policy within 7 days

Article 22 If, within 7 days from the date of the validity period of the three guarantees, it is necessary to replace the engine, transmission, power battery, driving drive motor or its main parts due to quality problems, consumers may choose to replace the household automobile products or return them with the car purchase invoice and the three-pack voucher. The seller shall replace or return the goods free of charge.

Refund and exchange rules within 60 days or within 3,000 kilometres (whichever comes first).

Article 23 If a steering system fails, a brake system fails, a body cracks, a fuel leakage or a power battery fire occurs within 60 days from the date of the validity period of the three guarantees or within 3,000 kilometers of the mileage (whichever comes first) due to quality problems, consumers may choose to replace the household automobile products or return the products with the car purchase invoice and the three-pack voucher. The seller shall replace or return the goods free of charge.

Return and exchange rules for 2 years or 50,000 km (whichever comes first).

The first return condition: due to serious safety performance failures, a total of 2 repairs have been carried out, but the failure has not been ruled out or a new serious safety performance failure has occurred;

The second condition of returning and replacing the car: the engine, transmission, power battery, and driving drive motor have been replaced twice due to their quality problems, and they still cannot be used normally;

The third return and replacement conditions: engine, transmission, power battery, driving drive motor, steering system, braking system, suspension system, transmission system, pollution control device, the same main parts of the body have been replaced twice due to quality problems, and still cannot be used normally;

The fourth condition for returning and replacing the car: the cumulative repair time due to quality problems exceeds 30 days, or the cumulative repair time due to the same quality problems exceeds 4 times.

Q: What are the main components?

A: In the three-pack voucher for each new car, there is a clear list of the main parts of the engine, gearbox, battery and motor. If there is a quality problem, after the 4S shop test, determine which part is broken, the consumer and the parts list on the explicit list to compare, as long as it is on, you can return and replace the car.

Q: Returning the car, or changing the car? Who decides?

A: Once the "car three guarantees" condition is met, it is up to the consumer to return the car or change the car, not by the car manufacturer or the 4S shop.

Q: What is a critical safety performance failure?

A: The Guidelines for Judging Serious Safety Performance Failures of Household Automobile Products issued in 2013 stipulate seven types of serious safety performance failures: brake failure, steering failure, power failure, safety device failure, vehicle fire, loss of vision, and vehicle attitude loss.

Q: The consumer obviously went to the 4S shop to repair it 4 times, but the 4S shop only admitted it 3 times, what should I do?

A: Every time the maintenance, the consumer asks the 4S shop for the maintenance list, if the 4S shop refuses to give, you can record the process, which can be used as the basis for returning and replacing the car in the future.

Q: The 4S store invoices the consumer first, and a month later, delivers the vehicle. How do I determine that the warranty period has officially begun?

A: There are two ways: the first way is to let the 4S store write a written delivery date, stamp it, and prove that the warranty period begins; the second way, the consumer is present, and the 4S store enters the warranty period into the car manufacturer's system.

Q: During the warranty period maintenance, can 4S shop provide scooters?

A: Within 3 years or 60,000 kilometers, there are quality problems, maintenance exceeds 5 days, and from day 6, the 4S shop will provide scooters. If you don't have a car, you have to reimburse the transportation fee.
