Defendant Wang Moubo (born in 1990) and victim Wang Mougang (born in 1976) are both villagers of Wangtang Village, Yugou Town, Lingbi County. At about 16:00 on February 3, 2021, Wang Moubo's father Wang Moubao and Wang Mougang's father Wang Moumin quarreled over the matter of taking out garbage, and then beat each other. After Wang Moubo arrived at the scene, he quarreled with Wang Mougang and slashed Wang Mougang with a kitchen knife, after which Wang Mougang was sent to Xuzhou City Hospital of Traditional Chinese Medicine for treatment, and died due to excessive blood loss at 23:00 on the same day.

A few days ago, the Suzhou Municipal Intermediate People's Court issued a criminal attached civil judgment, and the defendant Wang Moubo committed intentional homicide and was sentenced to death, suspended for two years, and deprived of political rights for life. On January 1, 2022, Wang Mougang's younger brother Wang Mouzang told Xin'an Evening News, Anhui Net, and Dawan News that they were not satisfied with the verdict and had filed an appeal to the Anhui Provincial High People's Court.

After trial by the Suzhou Intermediate People's Court, it was ascertained that the homestead of Wang Moubo's father, Wang Moubao, and Wang Mougang's father, Wang Moumin's homestead, were adjacent to the north and south. At about 16:00 on February 3, 2021, Wang Mougang and his father Wang Moumin connected wires behind the house of villager Wang Moufeng. Wang Moubao arrived at the scene and accused Wang Moumin of not taking out garbage on the south side of Wang Moubao's homestead, and the two quarreled, and then beat each other. After hearing the news, Wang Moubo rushed to the scene with a kitchen knife, chased and slashed Wang Mougang with a kitchen knife, and slashed Wang Mougang's head, shoulders, waist and back, wrists and ankles. After Wang Moubo fled the scene. Wang Mougang was successively sent to Yugou Town Health Center and Xuzhou City Hospital of Traditional Chinese Medicine for treatment. At about 23:00 on the same day, Wang Mougang died due to excessive blood loss and ineffective rescue. According to the appraisal of Suzhou Public Security Judicial Appraisal Center, Wang Mougang died of hemorrhagic shock caused by sharp weapon injury.

After Wang Moubo fled the scene, he contacted defendant Wang by phone. Wang Mou, knowing that Wang Moubo was holding a kitchen knife and slashing others, still drove to the place designated by Wang Moubo to pick up Wang Moubo and sent him to the intersection of Wangfang Village in Dalu Township, Lingbi County. After the defendant Li Moulong received Wang Moubo's phone call, he went to the intersection of Wangfang Village in Dalu Township to take Wang Moubo to his grandfather's house to hide, and then to his home to hide. At about 1:00 a.m. the next day, Wang was arrested by the public security police at his home in Yugou Street, Yugou Town, Lingbi County. At about 4 o'clock, when the public security police went to Li Moulong's home in Dalu Village, Dalu Township, to investigate, Li Moulong asked Wang Moubo to escape from his home. The public security police then arrested Li Moulong. At about 10 o'clock, Wang Moubo was arrested by the public security police in Zhenglou Village, Yugou Town, Lingbi County.

The Suzhou Intermediate People's Court's Criminal Attached Civil Judgment shows that during the trial of the Suzhou Intermediate People's Court, the close relatives of defendant Wang Moubo voluntarily handed over the compensation to the Suzhou City Intermediate People's Court on behalf of Wang Moubo, and after the judgment took effect, the compensation was paid to Wang Mougang's close relatives. Defendants Li Moulong and Wang Mou respectively obtained the forgiveness of the close relatives of the victim Wang Zhigang by paying compensation.

The murderer's death was suspended in the first instance, and the victim's family appealed

The public security police extracted the surveillance video of the scene of the crime, and the video showed that at 16:33:10 on February 3, 2021, Wang Moubao and Wang Moumin had a fight, Wang Moumin smashed a teacup, Wang Moubao picked up things from the ground and smashed it, and Wang Moubo chased and slashed Wang Mougang with a knife. At 16:49:50, the ambulance arrived at the scene. At 16:59:35,120, the ambulance pulled Wang away.

The Suzhou Intermediate People's Court held that the defendant Wang Moubo could not handle the dispute between his father and his neighbor correctly, and after drinking, he took a kitchen knife and continuously slashed the victim Wang Mougang, causing Wang Mougang to die of hemorrhagic shock after rescue was ineffective, and his behavior constituted the crime of intentional homicide.

After defendant Wang Moubo was brought to justice, he was able to truthfully confess the main facts of the crime, which was a confession; he voluntarily compensated and his close relatives compensated the economic losses of the victim's close relatives on his behalf. The consequences of Wang Moubo's crime are serious, and the death penalty should be sentenced to death on the basis of the crime, in view of the fact that this case is caused by a neighborhood dispute, Wang Moubo has a confession circumstance, voluntary compensation and other circumstances, and the death penalty can be sentenced without immediate execution. Defendant Wang Mou knew that Wang Moubo was a person who committed a crime, but still drove him to help Wang Moubo escape, and his behavior constituted the crime of harboring. Defendant Li Moulong, knowing that Wang Moubo was a criminal, provided Wang Moubo with a hidden place to help Wang Moubo escape, and his conduct constituted the crime of harboring.

The court ruled as follows: Defendant Wang Moubo committed intentional homicide and was sentenced to death with a two-year suspension of execution and deprivation of political rights for life; Defendant Li Moulong committed the crime of harboring and was sentenced to three years' imprisonment with a four-year suspension; Defendant Wang Committed the Crime of Harboring and was sentenced to three years' imprisonment with a suspended sentence of three years; a kitchen knife seized in the case was confiscated; defendant Wang Moubo compensated the plaintiff in the attached civil lawsuit (Wang Mougang's parents, wife, Sons and Daughters) economic losses of RMB 56,660.23 (which have been handed over to the Suzhou Intermediate People's Court and to be paid to the plaintiffs in the attached civil actions after the judgment takes effect); the other claims of the plaintiffs in the attached civil actions are rejected.
