On the morning of January 18, the case was heard in a remote hearing at the Hefei Intermediate Court, and Wang Moujin, 58, stood in the court's remote interrogation room for trial.

The prosecution court alleged that the defendant Wang Moujin and the victim Wang Moujin had a conflict over the demolition of the house and the payment of rent, and had accumulated a long-standing grudge. At 9:38 p.m. on February 4, 2021, the victim Wang X sent a voice message to insult defendant Wang Moujin in the family WeChat group, and the two of them met to stab each other with knives in the southeast corner of the intersection of Hehuai Road and Qingyuan Road in Luyang District, Hefei City.

At 10:35 p.m. that night, Wang Moujin arrived at the agreed place, saw the victim Wang XX, and stabbed Wang XX in the left chest with a knife, and the two of them fought and fell in the green belt, and after Wang XX fell to the ground, Wang XX fled the scene, and the victim Wang XX died after rescue was ineffective.

After appraisal, the victim Wang Moumou was stabbed in the left chest by a single-edged sharp weapon, causing the aortic arch to rupture, the left lung to rupture, and death from major blood loss.

The prosecution believes that the defendant Wang Moujin deliberately and illegally deprived others of their lives, and his behavior violated the criminal law. The facts of the crime are clear and the evidence is truly sufficient, and they should be investigated for criminal responsibility for intentional homicide.

Charged with intentional homicide, the verdict was not pronounced in court

In court, Wang Moujin said that the allegations were true.

Wang Moujin is a taxi driver, and his review of the killing is because his nephew Wang Moumou sent a voice in the family group, verbally insulted himself, and asked him to meet and stab each other that night. After the two people met, they wrestled and stabbed Wang Moumou with a knife.

The testimony of many witnesses shows that Wang Moujin and Wang Moujin are uncles and nephews, and they have been in conflict with each other due to problems such as house demolition and rent payment, and they have accumulated grievances for a long time. And confirmed that on the night of the crime, Wang Moumou sent a voice insult in the family WeChat group to insult Wang Moujin.

The public prosecutor presented in court the criminal understanding agreement reached between the family of defendant Wang Moujin and the father of the victim Wang Moujin and issued a criminal understanding.

In court, Wang Moujin's defense lawyer proposed that the case should be indirect intentional homicide, and Wang Moujin did not actively seek the death of Wang XX, but called his relatives after the incident and informed him to rescue Wang XX, so it was seen that he was not actively pursuing the occurrence of the death result.

However, this opinion was refuted by the prosecutor in court, who argued that, on the issue of direct intention and indirect intention, the evidence in the file of this case is very obvious, the two men met with knives to the scene of the crime, and the facts proved that both parties went with knives, and the purpose of both sides was obvious, and the subjective intention of this case was obviously direct intention rather than indirect intention.

The plaintiff's agent requested that Wang be sentenced to a criminal penalty for intentional homicide, in which the victim's family proposed attached civil compensation, claimed from Wang Moujin for death compensation, child support, funeral expenses and other economic losses totaling 966347 yuan, and required defendant Wang Moujin to cooperate with the victim's children in registering their real estate.

The verdict was not pronounced in court.
