In accordance with the laws and regulations of the People's Republic of China and the regulations of the General Administration of Customs of the People's Republic of China and the Ministry of Agriculture, Fisheries and Animal Rights of the Republic of Malta on the inspection and quarantine requirements of Maltese aquaculture products exported to China, from November 22, 2023, the import of Maltese farmed aquatic products that meet the following relevant requirements will be allowed.

1. Basis for inspection and quarantine

(1) "Law of the People's Republic of China on the Quarantine of Animals and Plants Entering and Leaving the Country", "Regulations on the Implementation of the Law of the People's Republic of China on the Quarantine of Animals and Plants Entering and Leaving the Country", "Law of the People's Republic of China on the Inspection of Import and Export Commodities", "Regulations on the Implementation of the Law of the People's Republic of China on the Inspection of Import and Export Commodities", "Food Safety Law of the People's Republic of China", "Regulations on the Implementation of the Food Safety

(2) "Measures of the People's Republic of China for the Administration of Import and Export Food Safety" and "Regulations of the People's Republic of China on the Registration and Administration of Overseas Manufacturers of Imported Food";

(3) Protocol between the General Administration of Customs of the People's Republic of China and the Ministry of Agriculture, Fisheries and Animal Rights of the Republic of Malta on Inspection, Quarantine and Veterinary Health Requirements for Aquaculture Products Exported from Malta to China (hereinafter referred to as the "Protocol").

Second, the scope of imported products

Artificially farmed aquatic animal products and their products, algae and other marine plant products and their products for human consumption, excluding species listed in the appendix of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) and the List of Wild Animals under National Key Protection of China (LSKPWA), live aquatic animals and aquatic animal and plant breeding materials. The catalogue of Maltese aquaculture products exported to China is shown in the annex.

3. Requirements of production enterprises

Maltese production enterprises (including processing enterprises and DULI cold storage) and farms exporting aquaculture products to China shall be subject to the official approval and effective supervision of Malta. The hygienic conditions of the manufacturer shall comply with the requirements of the relevant food safety laws and regulations of China and Malta.

According to Chinese laws and regulations, production enterprises exporting aquaculture products to China shall be recommended for registration by the Ministry of Agriculture, Fisheries and Animal Rights of the Republic of Malta (hereinafter referred to as the "Malaysian side") to the General Administration of Customs of the People's Republic of China (hereinafter referred to as the "Chinese side"). It is not allowed to be exported to China without registration.

Fourth, the requirements of imported products

Malaysia should ensure that the aquaculture products exported to China meet the following conditions:

(i) aquaculture in Maltese domestic waters;

(2) Neither the raw materials nor the products are in the area covered by the following issues:

1. The occurrence of aquatic animal diseases related to the products of the Protocol as specified in the List of Quarantine Diseases of Imported Animals of the People's Republic of China and required by the World Organisation for Animal Health (WOAH) to be notified in Malta, causing aquatic products exported to China to be or may be affected by GANRAN;

2. Any major food safety incident in Malta has affected or may affect the export of aquaculture products to China;

3. Malaysia's aquaculture products that have been exported or are intended to be exported to China seriously violate the laws and regulations of China and Malta as well as the provisions of the Protocol;

4. MAJOR PUBLIC HEALTH INCIDENTS OCCUR IN PRODUCTION ENTERPRISES, SUCH AS MAJOR INFECTIOUS DISEASES OF EMPLOYEES GANRAN, WHICH HAVE CONTAMINATED OR MAY CONTAMINATE AQUATIC PRODUCTS EXPORTED TO CHINA AND THEIR PACKAGING AND MEANS OF TRANSPORTATION;

5. The breeding area is affected by pollutants, such as radioactive pollutants, which have been contaminated or may contaminate aquaculture products exported to China.

(3) Failing to directly or indirectly (such as adding drugs or additives prohibited by both parties) and using drugs or additives that are restricted or permitted by both parties in accordance with the regulations. After inspection by the competent authorities, no pathogenic microorganisms, toxic and harmful substances and foreign substances listed in the laws and regulations of China and Malta have been found;

(4) All aquaculture products exported to China have been quarantined and inspected by the competent authorities, are hygienic, safe, and suitable for human consumption, and no pathological indications of infectious diseases and parasitic diseases have been found, and no aquatic animal diseases listed in the List of Quarantine Diseases of Imported Animals of the People's Republic of China and must be notified by WOAH;

(5) The whole process of breeding, processing, packaging, storage, transportation, transit and export shall comply with the relevant health requirements and traceability requirements of both sides. At the same time, it should meet the relevant safety and health requirements of the cold chain.

5. Quarantine approval requirements

The import of Maltese farmed aquatic products shall go through quarantine approval in advance and obtain the "Quarantine Permit for Imported Animals and Plants".

6. Certificate requirements

Each container of farmed aquatic products exported from Malta to China shall be accompanied by at least one original health certificate certifying that the batch of products complies with the relevant laws and regulations on food safety in China and Malta and the relevant provisions of the Protocol. The Malaysian side shall completely fill in the information of the production enterprises involved in the whole process of breeding, processing, packaging, storage, transportation, transit and export, including the names and registration numbers of the farms, processing plants and DULI cold storage, etc., on the health certificate, and shall not omit the information of the production enterprises involved in any of the above links.

The certificate should be printed in at least Chinese and English (English is a required language when filling in the certificate). The format and content of the certificate must be approved by both parties in advance. The Malaysian side shall promptly provide the Chinese side with a sample of the certificate, the seal of the official issuing authority and the handwriting of the signing official to the Chinese side for the record. If there is any change in the content and format of the sample certificate, the seal of the official issuing authority and the handwriting of the signing official, the Malaysian side shall file a record with the Chinese side at least one month before the effective date.

7. Packaging and labeling requirements

Aquaculture products exported to China (except whole tuna) should have outer packaging and separate inner packaging. The inner and outer packaging should be new materials that meet international health standards and meet the requirements of preventing contamination by external factors.

The inner and outer packaging shall have firm, clear and legible labels in Chinese and English, indicating the following: trade name and scientific name, specifications, production date, batch number, shelf life and storage conditions, production method (breeding), production area (country or region where the aquaculture products are located), name, registration number and address of all production and processing enterprises involved (including DULI cold storage) (specific to the state/province/city), destination (must be marked as the People's Republic of China).

For aquaculture products exported to China in the form of pre-packaging, the pre-packaged Chinese label shall meet the labeling requirements of pre-packaged food imported from China.

8. Other requirements

China Customs implements import inspection and quarantine of aquaculture products exported to China.

For unqualified products, they will be returned, destroyed or otherwise disposed of in accordance with Chinese laws and regulations. For manufacturers that have serious problems or multiple non-conforming problems, China will take measures such as strengthening inspection and quarantine or suspending imports.
