Notice on production and registration management

The competent departments for industry and informatization of all provinces, autonomous regions, municipalities directly under the Central Government and the Xinjiang Production and Construction Corps, public security departments (bureaus), relevant road motor vehicle production enterprises and technical service agencies:
In recent years, there have been many road traffic accidents caused by the illegal loading of people and goods by light trucks and small and micro passenger cars, causing major losses to the safety of people's lives and property, and becoming a serious road traffic safety hazard. In order to implement the requirements of the "National Three-year Action Plan for Special Rectification of Work Safety" and the "Three-Year Action Plan for The Special Rectification of Road Transport Safety", effectively strengthen the production and registration management of vehicles, and further improve the safety technical performance of light trucks and small and micro passenger cars, the relevant matters are hereby notified as follows:
First, improve the safety technical requirements for light trucks and small and micro passenger cars
(1) In order to effectively eliminate the "large ton and small standard" and overload transportation hidden dangers of light trucks from the source of the product, and curb the illegal modification of small and micro passenger cars, from the date of the issuance of this notice, the newly declared "Road Motor Vehicle Manufacturers and Product Announcements" (hereinafter referred to as the "Announcement") of light truck products should increase the material, thickness, weight and other parameter information of the cargo compartment, and the small and micro passenger car products should increase the parameter information such as seat layout and fixing method. In addition to complying with the requirements of relevant national policies and mandatory standards, the newly declared products and the products in production listed in the Announcement must also meet the requirements of the "Safety Technical Specifications for Light Trucks, Small and Micro Passenger Vehicles" (hereinafter referred to as the "Technical Specifications") annexed to this notice. New products that do not meet the requirements of the Technical Specifications of this Notice will not be announced by the Ministry of Industry and Information Technology.
(2) Products in production that do not meet the requirements of the "Technical Specifications" of this Notice, from March 1, 2022, the production enterprises should immediately stop production, and the relevant institutions should immediately stop receiving the relevant product certificate information; among them, for the light trucks in production that have been included in the "Announcement" with an displacement greater than 2.5 liters but meet the other requirements of this notice, a transition period of 6 months is given for production and sales, and after the expiration of the transition period, the production enterprises should immediately stop production, and the relevant institutions should immediately stop receiving the relevant product certificate information.
(3) For inventory products that have been produced before March 1, 2022 and have uploaded a certificate of conformity, but do not meet the requirements of the "Technical Specifications" of this Notice, the production enterprise may submit an application for inventory extension sales to the Ministry of Industry and Information Technology, and attach the inventory list and the written materials of the production enterprise on the non-compliance of the "large ton small standard" and voluntarily bear the relevant legal responsibilities of the product, and after performing the relevant procedures such as verification and publicity, the 6-month extension of sales and registration period may be given. According to the specific situation of the progress of the special rectification action for road transport safety, the Ministry of Industry and Information Technology and the Ministry of Public Security will revise and improve the "Technical Specifications" in due course.
Second, the implementation of the production enterprises product safety quality, production consistency of the main responsibility
(4) Production enterprises shall improve the awareness of safety responsibility and risk prevention and control, strictly implement the main responsibility for product safety and quality and production consistency, carry out production and operation in accordance with the law and trustworthiness, improve the relevant management system, strengthen the safety and quality inspection of vehicle products before leaving the factory, ensure that the mass-produced products meet the requirements of national mandatory standards and relevant regulations, ensure that the wholesale products are consistent with the specifications and parameters of the approved models of the announced type, and effectively improve the safety performance of vehicle products.
(5) Truck production enterprises produced by the commission reform method bear the full responsibility for the safety and quality and production consistency of the commission's reformed products, and should formulate measures to strengthen the management of the commissioned and reformed enterprises, implement quality control and production consistency management for the entrusted modified vehicle products, and ensure that the parameters of the commission's reformed products are consistent with the licensing parameters.
(6) Production enterprises should strengthen the management of the motor vehicle factory certificate, fill in and transmit the electronic information of the certificate of conformity in real time after the completion of the manufacture of the motor vehicle and the inspection of the certificate, the information contained in the certificate of conformity shall be consistent with the technical parameters of the product and the actual technical parameters of the product in the Announcement, and shall not sell the motor vehicle that has not yet transmitted the electronic information of the certificate of conformity, and it is strictly forbidden to upload the electronic information of the vehicle qualification certificate of the unproduced off-line motor vehicle. It is strictly forbidden to issue a motor vehicle factory certificate of different models of the Announcement for the same motor vehicle, and it is strictly forbidden to issue a vehicle factory qualification certificate for vehicles that fail to pass the inspection and do not meet the requirements of production consistency. For the announced products that do not meet the requirements of this notice, the production enterprise shall organize the design rectification, and if the rectification is confirmed to meet the requirements, the production of the product and the transmission of the certificate of conformity may be resumed.
Third, strictly control the product testing of vehicle product inspection agencies
(VII) Vehicle inspection institutions undertaking the vehicle product testing work of the "Announcement" should strictly control product testing, and when inspecting the sample vehicles declared for the "Announcement", they shall strictly follow the national standards and relevant regulations, shall not reduce the inspection items, shall not reduce the inspection standards, and strictly implement the sample traceability system for the inspection samples to be retained for 3 months.
(8) The inspection agency should strictly test the no-load of truck products, focus on testing the maintenance quality of truck products, ensure that the vehicle is equipped with tools, spare tires, water tanks, fuel tanks are measured under the conditions of provisions and filling, strictly verify whether the configuration of the vehicle engine, tires, axles, leaf springs and other configurations match the total quality of the declared model, and the video of the inspection process should be retained for not less than 6 years; for those involved in the full load test, the load installation method and method should be explained in the test report, and the load installation photo should be attached, and the relevant video should be saved, among which, If the full load is detected using simulated loads such as large weights, it should also be evaluated whether the strength of the carriage (body) matches the declared carrying capacity of the vehicle. If it is found that the model configuration, cargo space and total quality do not match, are unreasonable, or there are models produced by the production enterprise and used "duty carriage (body)" for inspection, the inspection agency should stop the inspection in time and report to the competent department. It is necessary to strictly check the static inspection of small and micro passenger cars, focusing on checking whether the seat arrangement of the vehicle and the rear space of the carriage comply with the provisions of this notice. For inspection institutions that do not carry out product inspection in accordance with the above requirements and cause serious testing quality accidents, the Ministry of Industry and Information Technology will suspend the acceptance of their inspection reports and notify the relevant departments to deal with them in accordance with laws and regulations.
Fourth, strengthen the production consistency supervision of vehicle products
(IX) The Ministry of Industry and Information Technology will work with local competent departments to carry out production consistency supervision and inspection around light trucks, small and micro passenger car manufacturers and products, problem-oriented, and combined with key inspections and "double random". The competent departments of industry and informatization at all levels should strengthen the production consistency supervision of vehicle manufacturers, and urge vehicle production enterprises to improve the safety technology level of light trucks, small and micro passenger cars and other products.
(10) Industry and information technology departments and public security traffic management departments should strengthen coordination and cooperation, further improve information exchange and linkage mechanisms, further improve the vehicle qualification certificate information comparison system, and implement joint early warning and joint disposal of suspect vehicles such as "large tons and small standards" found in vehicle registration, law enforcement inspection, and accident investigation and handling. Production enterprises and products that are confirmed to have production consistency violations such as those that do not meet the relevant national technical standards and the requirements of the "Technical Specifications" of this Notice shall be dealt with strictly and severely by the department of industry and information technology, suspend or revoke the "Announcement" of the products that do not meet the requirements in accordance with laws and regulations, and notify the public security traffic management department of the handling results, and the public security traffic management department will not handle registration. After the promulgation of this "Notice", if the production enterprise still produces and sells "large tons and small standard" products, "one vehicle and two certificates", or participates in or assists in the use of "duty carriage (body)" to fraudulently obtain motor vehicle license plates, once confirmed, the departments of industry and informatization, public security traffic management and other departments will deal with them strictly and severely in accordance with laws and regulations, and order the enterprise to withdraw the illegal products, and will no longer accept the enterprise's application for the "Announcement" of the new automobile product within one year; if it constitutes a crime, the person in charge of the enterprise will be investigated for criminal responsibility according to law.
Fifth, strict registration management of light trucks and small and micro passenger cars
(11) All local public security traffic management departments should strictly register and inspect light trucks, small and micro passenger cars, etc., inspect vehicles in strict accordance with relevant provisions and standards, and do not handle registration for those whose main characteristics and technical parameters do not meet national standards, or are inconsistent with the "Announcement" and certificates of conformity. It is necessary to strictly register and inspect light trucks, focusing on checking whether the quality of the maintenance recorded in the inspection and qualification report of light trucks is consistent with the quality of the maintenance recorded in the "Announcement" and the certificate of conformity, and it is strictly forbidden to register vehicles with "large tons and small standards". It is necessary to strictly check the registration and inspection of small and micro passenger cars, focusing on checking whether the vehicle's outer dimensions, seat arrangement and fixation, tire specifications, and safety devices such as anti-lock braking system (ABS) comply with regulations. Where it is found that there is a suspicion of illegal production or illegal modification of the vehicle, an on-site investigation shall be carried out in accordance with the regulations, and the basic information of the suspect vehicle and the information of the vehicle manufacturer, production date, announcement batch and other information shall be recorded in detail, and the evidence of the violation shall be fixed and reported through the information system. For the "large ton and small standard" light truck products in use, the production enterprise may rectify and change the corresponding truck product model in the "Announcement"; for the seat arrangement of the small and micro passenger car in use that does not meet the requirements of the "Technical Specifications" of this Notice, the production enterprise is encouraged to rectify and change; if illegal modification is involved, it shall be restored to the original state.
(12) The public security traffic management department shall, in conjunction with relevant departments, supervise and urge the motor vehicle safety technical inspection agency to strictly inspect the quality of the truck's maintenance, engine model, cargo box size, tire and passenger car profile size, seat arrangement and fixing, tire specifications, and anti-lock braking system (ABS) and other items, and shall not issue inspection reports that are inconsistent with the "Announcement" and national standards. Strictly investigate the responsibility for inspection and registration in violation of regulations, and if it is found that the inspection agency has issued false inspection results for illegal vehicles such as "large tons and small standards", it will be punished in accordance with law, and the acceptance of the motor vehicle inspection report issued by the institution will be suspended, and the relevant departments will be notified to revoke the qualification identification certificate; and those who do not check the illegal vehicles such as "large tons and small standards" and other illegal vehicles that are not inspected in accordance with regulations shall be dealt with strictly and severely in accordance with law; and those that constitute a crime shall be investigated for criminal responsibility. Strictly carry out in-depth investigation of accidents, and where "large tons and small standards" trucks and illegally modified passenger cars cause a traffic accident in which 3 or more people die at a time, the legal responsibility of the illegal production and sales enterprises and relevant responsible persons shall be investigated in accordance with law; where a crime is constituted, criminal liability shall be pursued.
