The judgment obtained by The Paper (www.thepaper.cn) shows that the court held that the behavior of the two defendants broke through the bottom line of human morality, morality and law, seriously deviated from the core socialist values, and had a bad social impact. Moreover, the motives of the two men were particularly despicable, the subjective malignancy was extremely deep, the means of committing the crime were particularly cruel, the circumstances of the crime were particularly bad, and the consequences and crimes were extremely serious. Such crimes that seriously infringe upon minors and challenge the bottom line of human morality shall be severely punished in accordance with law.

With regard to the defender's question of the principal accessory, the court held that Ye Chengchen and Zhang Bo had a similar status and role in the joint crime, and rejected Ye Chengchen's accomplice's defense opinion.

The Paper has learned from relevant parties that the lawyers of the two defendants have not yet met with the defendants, and it is not clear whether the two defendants will appeal.

The police restored more than 10,000 chat records to clarify the case

On the afternoon of November 2, 2020, xuexue (2 years old) and Yang Yang (1 year old), who lived on the 15th floor of unit 4 of Jinjiang Huafu in Nan'an District, fell to their deaths. The video on the day of the crime showed that after the two young children fell to their deaths, their biological father Zhang Bo sat paralyzed on the ground, crying and slapping his legs, showing "grief" and even hitting his head against the wall.

Zhang Bo was quickly recognized. The verdict shows that after the incident, Zhang Bo's statement aroused suspicion from the police, and all the WeChat chat records between him and his girlfriend Ye Chengchen were deleted, and the police believed that it was unreasonable, so they filed a case for investigation on the suspicion that Zhang Bo was suspected of causing death by negligence. After the police extracted and seized Zhang Bo and Ye Chengchen's mobile phones, the technical department restored more than 17,000 WeChat chat records, and found that the two had the idea of disposing of the two children in order to clear the barriers to marriage, which was suspected of major crimes.

On November 10 last year, the police falsely notified Zhang Bo and Ye Chengchen to go to the police station to collect their mobile phones and arrested them. On November 11, the case of Zhang Bo and Ye Chengchen's intentional homicide was filed and investigated.

The Surging News previously reported that around April 2019, Zhang Bo, who was married and had two children, met with netizen Ye Chengchen and later became a lover, and in February 2020, Zhang Bo and his wife agreed to divorce.

According to the verdict, the police investigation found that Zhang Bo and Ye Chengchen had discussed killing two children around February 2020, and Zhang Bo had been hesitant.

After June 2020, seeing that Zhang Bo still hadn't attacked the two children, Ye Chengchen said to Zhang Bo in WeChat: "Anyway, I can't accept the baby, you can solve the baby immediately." ”

Zhang Bo replied in the chat: "If something happens to the baby, you are not qualified to say that I am a second-married child." Ye Chengchen said, "I'm not qualified to say anything about you." ”

In this regard, Zhang Bo proposed: "2 lives are so unworthy." Ye's reply was: "We shouldn't have existed in the first place, and we wouldn't be happy with them." ”

For Ye Chengchen's remarks, Zhang Bo said: "Therefore, it is for you that I have done these things that hurt nature and reason. Ye responded, "Can you prove that you love me or not?" ”

On October 20, 2020, seeing that Zhang Bo had not yet attacked the child, Ye Chengchen proposed in WeChat: "It is all your 2 baggage problems" and "Are you going to give me an accurate time?" ”

Zhang Bo replied: "Within 10 months, if you don't do a good job anyway, our people (Note: Chongqing dialect, meaning themselves) will not come to see you." Ye Chengchen said: "Up to 10 days time", "Anyway, this week is the last time." ”

At 3:30 p.m. on November 2, 2020, Zhang Bo took advantage of his mother's outing and threw his son and daughter, who were playing on the bay window sill in the second bedroom, with their legs around them and threw them downstairs from the bay window on the 15th floor.

When the case was first heard in July this year, Zhang Bo and Ye Chengchen blamed each other in court that the other party had raised their intentions.

In this regard, the court held that the WeChat chat content of the two defendants and other evidence in the case could not confirm which of the two defendants first proposed the offense, so the evidence that found that the initiation of the offense was Zhang Bo or Ye Chengchen did not meet the standard of credible and sufficient proof. Ye Chengchen's relevant defense could not be established, and the court did not accept it.

The court found that Ye Chengchen and Zhang Bo's WeChat chat records from May 28 to November 2, 2020 confirmed that in order to achieve the purpose of marriage, the two defendants repeatedly conspired to take Zhang Bo's daughter (who was raised by her birth mother) to Zhang Bo's home in order to let Zhang Bo kill two children at the same time, and Ye Chengchen repeatedly urged and forced Zhang Bo to commit the crime, and set a time limit for Zhang Bo to commit the crime. The second defendant also confessed to the fact that Gong killed the second victim.

The court held that, based on the available evidence, it was sufficient to determine the fact that Zhang Bo and Ye Chengchen jointly killed the two victims.

The court did not accept the defence that the female defendant was an accessory

At the first hearing of the case, one of the focal points of the trial was the issue of Ye Chengchen's main accessory, the defender believed that Ye Chengchen was an accessory, but the prosecution believed that the two defendants were of equal status, and the court did not express its position in court.

The judgment states that the court held that after Zhang Bo conspired with Ye Chengchen and was forced by Ye Chengchen to deliberately and illegally deprive Zhang Bo's two innocent minor children of their own children by creating an unexpected high fall, resulting in the death of the two. Zhang Bo and Ye Chengchen's actions have constituted intentional homicide. The public prosecution charged the two defendants with the facts and charges of the crime.

In the joint crime, Zhang Bo actively participated in the conspiracy involving the direct killing of two biological children by taking his daughter to his home.

Ye Chengchen actively pursued the death of the second victim, repeatedly urged Zhang Bo to kill the two children on the grounds that he and his family could not accept that Zhang Bo had children, and in the case of Zhang Bo's hesitation, he forced Zhang Bo to carry out the act of homicide on the grounds that his family did not agree to the two being together, breaking up, not meeting, etc., and set a deadline for Zhang Bo to commit the crime, and actively offered advice, and finally prompted Zhang Bo to directly commit the crime of intentional homicide.

Based on this, the court held that Ye Chengchen and Zhang Bo had a comparable status and role in the joint crime, and rejected Ye Chengchen's defender's defense opinion that Ye Chengchen was an accessory.

Aberration: Women with violent self-harm tendencies are in an absolutely active position

The court trial found that in the process of Ye Chengchen's interaction with Zhang Bo, Ye Chengchen was in an absolutely active position, and there was a tendency to violence and self-harm by cutting his wrists, and the WeChat chat content between Ye Chengchen and Zhang Bo could also reflect Ye Chengchen's strong position, and his thoughts and behaviors were extreme.

The content of the WeChat chat of the two defendants proves that Ye Chengchen actively advised Zhang Bo, repeatedly urging and forcing Zhang Bo to carry out murderous acts on the grounds that his family did not agree to the two being together and breaking up, and that the original intention of Ye Chengchen's breakup was to force Zhang Bo to meet his wishes and pursue the purpose of the two being together, not that what he claimed was to force Zhang Bo to leave him.

In addition, the content of the WeChat chat between the two also proves that Ye Chengchen used whether Zhang Bo committed murder as a manifestation of whether Zhang Bo loved himself.

The court also found that Zhang Bo had also been cut by Ye Chengchen with a kitchen knife, and Ye Chengchen also took a knife to let Zhang Bo self-harm, otherwise she would cut her wrist. Witness testimony shows that Ye Chengchen also used an ashtray to break Zhang Bo's head. Those who participated in the trial told The Paper, and the judge said in court that after examining Zhang Bo's injuries, he had multiple knife wounds on his body.

At the first trial, Zhang Bo said that on the day of the crime, Ye Chengchen cut his wrist and forced him. But Ye Chengchen said that she cut her wrist to make Zhang Bo retreat from herself.

In this regard, the court's review found that because Zhang Bo and Ye Chengchen had been chatting through WeChat video at the time of the case, both of them deleted the WeChat content in their mobile phones after the incident, resulting in the inability to restore the video content. Although there is evidence to prove that Ye Chengchen's left wrist has two obsolete scratches that run rampant, based on the available evidence, it is impossible to determine the formation time of the two scratches on Ye Chengchen's left wrist.

The court ultimately held that the evidence that Ye Chengchen threatened suicide by cutting his wrist at the time of the case did not meet the standard of credible and sufficient proof, and did not recognize this.

Crimes that seriously violate minors and challenge the bottom line of human morality should be severely punished

The court found that Zhang Bo had cheated in marriage, Ye Chengchen knew that Zhang Bo was married and had children, still interacted with him, and repeatedly stated that he could not accept Zhang Bo's children, and the two defendants repeatedly conspired to kill Zhang Bo's own children by creating an unexpected high fall in order to achieve the purpose of marriage.

Eventually, under the persecution of Ye Chengchen, Zhang Bo disregarded humanity and destroyed humanity, and threw his own children from the 15-story building, resulting in the death of two innocent minors.

After the incident, Zhang Bo dialed the 120 emergency number and cried bitterly at the scene of the fall to cover up the crime. Zhang Bo and Ye Chengchen deleted their WeChat chat records and colluded in a vain attempt to evade responsibility.

The court said that although Zhang Bo and Ye Chengchen verbally confessed their guilt in court, they did not really admit guilt and repent, and Ye Chengchen refused to confess the main facts of the crime during the trial.

After the case was disclosed on the Internet, it aroused great public concern and strongly condemned the behavior of the two defendants.

The court held that the conduct of the two defendants broke through the bottom line of human morality, morality and law, seriously deviated from the core socialist values, and had a bad social impact. The opinions of the second defender on the lenient punishment of the two defendants were not accepted.

In summary, according to the relevant provisions of the Criminal Law, the court convicted Zhang Bo and Ye Chengchen of intentional homicide, sentenced them to death, and deprived them of their political rights for life. If you are not satisfied with this judgment, you may appeal to the Fifth Intermediate Court of Chongqing Municipality or directly to the Chongqing Municipal Higher People's Court within 10 days from the second day of receipt of the judgment.
