Mr. Peng told reporters that on November 20, 2021, he ordered a Chery Small Ant eQ1 semi-sugar version of the new energy vehicle in full at the Chery Chengdu Jiahe 4s store, with a total price of 79,900 yuan and a red body color. However, for more than a month after that, Mr. Peng never received a pick-up notice from the 4s shop. An anxious Mr. Peng began to take the initiative to contact the sales staff of Chery Chengdu Jiahe 4s store, but the other party told Mr. Peng that because the vehicle was out of stock, the current Chery small ant eQ1 semi-sugar version is only white, if you want red, you need to wait for some time. Mr. Peng told reporters that he was reluctant to change the color of the body, so he had to continue to wait. In the following waiting time, he asked the 4s shop every time if he could pick up the car, but he would tell him the same reason, until more than 4 months had passed, and Mr. Peng still could not pick up the car. In order to better understand the process of the incident, the reporter called Chery Chengdu Jiahe 4s store, a manager Liu told reporters that Mr. Peng did order a Chery small ant eQ1 semi-sugar version of the new energy vehicle in the store on November 20, 2021, but there were only white cars in the store, and the red vehicle needed to place an order with Chery manufacturers and request shipments. However, for several months, Chery manufacturers have not sent red vehicles to the 4s store, during this period, the 4s store has also communicated with Mr. Peng many times whether it can be changed to white, but Mr. Peng has always insisted on the red body, so until now it is still impossible to pick up the car.
Subsequently, the reporter contacted the customer service staff of Chery Automobile, who said that they had contacted Mr. Peng and said that they would strive to arrange for the delivery of the red vehicle requested by Mr. Peng to the Chery Chengdu Jiahe 4s store at the end of April. The reporter also verified with Mr. Peng, who said that this was indeed the case, and he had accepted Chery Automobile's official handling of the matter.

Lawyer Chen believes that 1, we should agree on the delivery time when signing the car purchase contract, if the 4S shop does not deliver the car within the agreed time, it constitutes a fundamental breach of contract, and the 4S shop can be required to bear the compensation liability; 2, if the car purchase contract is not agreed upon when the car delivery time is signed, it can be re-agreed with the 4S shop afterwards; 3, if the two parties fail to reach an agreement on the delivery time, the car buyer can give the 4S shop a reasonable period of time, and if the 4S shop fails to deliver the car within a reasonable period of time, it can negotiate to terminate the contract; 4. If the two parties cannot reach an agreement, they may request the mediation department to conduct mediation; 5. If the above measures fail to solve the problem, they shall hire a professional lawyer to protect their legitimate rights and interests through legal channels.
