During the "Double 12" period, the Consumer Protection Commission of Jiangsu Province pointed out that the "shake a shake" open-screen advertising function of some apps was suspected of infringing on the rights and interests of consumers, and named the above situations in Baidu, Douban, Weibo, Himalaya and other apps, which triggered heated discussions. On December 27, the Jiangsu Provincial Consumer Protection Commission told Nandu reporters that at present, Baidu, Tomato Novel, Himalaya, and Huawei Music have promised to make rectifications in the form of "shake a shake" open-screen advertisement, and other named apps have not yet contacted the Jiangsu Provincial Consumer Protection Commission.

Nandu reporter noted that Baidu promised to add a new shielding "shake a shake" switch in the background, and the user permanently shielded the "shake a shake" screen after opening the switch. The opening screen page will add a text prompt "Baidu APP background supports blocking shake ads", reminding users to permanently block "shake a shake" ads in the background and provide independent choices.

In addition, Himalaya said it will add a closeable button to the interactive form of the "Shake It" ad in a future release. Tomato Novel promises to add a "Shake a Shake" setting button to the open screen ad page, where consumers can choose to turn off or turn on the "Shake A Shake" interactive form. Huawei Music said that it has suspended the "shake a shake" ad import form, and will enhance the negative feedback in the future to facilitate users to choose the form of advertising display.

At present, Weibo, Douban, Hupu and Lianxiangjia have not yet contacted the Consumer Protection Commission of Jiangsu Province.

The Consumer Protection Commission of Jiangsu Province believes that any form of open-screen advertising should be entered in a way that ensures that the user's intentions are reflected, the right to choose is respected, and cannot be deceived or misled. In addition, "shake it" ads require software to obtain specific mobile phone sensor data, and the current access to this data is not obtained without consumer consent. Relevant departments should pay attention to how the software takes into account data applications and consumer personal information protection when obtaining various sensor data of mobile phones.

On December 12, the Consumer Protection Commission of Jiangsu Province pointed out that some apps set "shake a shake" in the opening screen ads, which makes it easy for consumers to jump to the advertising page in the case of walking, taking a car or turning around, and these jumps are not the original intention of consumers. Merchants use misleading ways to induce users to enter the advertising page and disguise the act of forcing consumers to watch advertisements, which is suspected of infringing on consumers' right to make their own choices.

It is reported that "shake a shake" means that when the user opens a software, the opening screen advertising interface will automatically enter the advertising details page, jump to open the ad-related software, and even directly enter the software download page. Some software design "shake a shake" function is very easy to trigger, consumers hold the phone slightly unstable, walking when the center of gravity slightly undulating and other body posture changes, may trigger the "click on the advertisement" effect, forced to jump.
