The APP opening screen advertisement that cannot be hidden has a new trick, and it automatically jumps when it shakes

"I sat on the bus several times, and I wanted to use my mobile phone to open the APP to check information, but I didn't know how to automatically jump to the e-commerce platform." Mr. Xu, a citizen, said that he noticed that the trigger switch of many APP opening screen advertisements changed from "click" to "shake". The reporter recently investigated and found that Weibo, Baidu, Himalaya, Zhihu and other APP have appeared similar ads, many consumers are distressed by this, the original do not want to see the open screen ads as long as you click to skip it, and now sitting on the bus, walking on the road or the mobile phone will automatically open the third-party shopping platform.

Consumers: I didn't dare to mess around before, and now I don't dare to move

"Before, I didn't dare to mess around when I opened the program, but now I don't dare to mess around when I open the program." This is the current ridicule of the APP "shake a shake" open screen advertisement.

The APP opening screen advertisement that cannot be hidden has a new trick, and it automatically jumps when it shakes

Weibo APP's "Shake It Off" open-screen advertisement

Mr. Wang, a citizen who lives in Fengtai District, said: "When I opened the Weibo APP recently, I always saw this kind of open-screen advertisement, I just wanted to browse the hot search, and as a result, because of some slight shaking of the body, I was forced to go to Taobao. This experience made Mr. Wang feel very uncomfortable, and also generated more worries: "Will this kind of jump without my permission link my personal information from this APP to other APPS?" Will it leak my personal privacy? ”

Compared with the concerns of young people, the elderly are more at a loss when they encounter such "shake it" ads. "My mom has been yelling at the Himalayan APP to start selling things lately, and I can't listen to the drama anymore. I thought it was strange at first, and when I looked closely, I found that the old man had inadvertently triggered the switch of the Himalaya APP opening screen advertisement. Ms. Wu told reporters that her mother loved to carry her mobile phone and listen to the audio in the Himalaya APP when she was exercising in the park in the morning, but recently she always accidentally opened the app's opening screen advertisement while walking.

Customer service: There are currently no settings to turn off such ads

The reporter's experience found that the appearance of such "shake a shake" open screen advertisement is more random, and it is not encountered every time the APP is opened. After testing the "shake a shake" open-screen advertisement of the Weibo APP, the reporter found that it is indeed very easy to trigger such ads. The reporter only made an action of picking up the mobile phone from the desktop, and the "shake it" advertisement automatically jumped to the purchase platform on the WeChat Mini Program.

Subsequently, after many experiments, the reporter found that after opening the APP, put the mobile phone into the pocket, or walk around, trot, encounter the subway station brakes when taking the subway, etc. will involuntarily trigger the advertisement, at this time, it is often too late to click the "skip" word on the opening screen advertising page, and the screen will directly jump to the third-party product purchase interface.

Since this new pattern of open-screen advertising has been criticized so much, can consumers choose to close it? The customer service of the Himalaya APP said: "At present, the platform has carried out strict tests on the function of shaking a shake advertisement, and there will be no normal grip, slight shaking and jumping ads, but the "shake a shake" open screen advertisement cannot be closed, and the follow-up will continue to be optimized." Baidu APP customer service also said that you can click "Skip" to choose to skip advertising, but there is no shutdown function for the time being.

Consumer Protection Commission: Suspected of infringing on consumers' right to make their own choices

On December 12, the Jiangsu Provincial Consumer Protection Commission said through the official public account that although such open-screen advertising pages also have skip or close buttons, the "shake a shake" setting of merchants is very easy for consumers to jump to the advertising page in the case of walking, taking a car or turning around, etc., and these jumps are not out of the original intention of consumers. Merchants use misleading ways to induce users to enter the advertising page and disguise the act of forcing consumers to watch advertisements, which is suspected of infringing on consumers' right to make their own choices.

In addition, the Jiangsu Provincial Consumer Protection Commission said that the software through the "shake" to achieve advertising is to retrieve a certain sensor data of the mobile phone, but whether the retrieval is necessary, whether the software retrieval behavior obtains consumer consent and authorization is also questionable, whether the consumer's personal data security can be guaranteed is worrying.

After consulting with a lawyer, the reporter learned that the "shake a shake" open-screen advertisement has violated the relevant provisions of the Consumer Rights and Interests Protection Law. According to Article 9 of the Law on the Protection of Consumer Rights and Interests, consumers enjoy the right to choose goods or services independently. Consumers have the right to independently choose the business operators that provide goods or services, independently choose the variety of goods or service methods, and independently decide to purchase or not to purchase any kind of goods, and to accept or not to accept any service.
