Another internet celebrity restaurant was fined...

Using flounder to impersonate cod, the Shanghai net red Japanese food store "Yixu Shoukiyaki" was administratively punished by the Yangpu District Market Supervision Bureau for 500,000 yuan for false publicity. In this regard, the Shanghai Municipal Consumer Protection Commission said that the restaurant is shoddy, so that the legitimate rights and interests of consumers are damaged, and they should bear relevant responsibilities. Regarding the issue of the company's civil liability, the Shanghai Municipal Consumer Protection Commission will follow up and intervene.

On September 13, 2021, law enforcement officers from the Yangpu District Market Supervision and Administration Bureau of Shanghai inspected the Hopson Hui store of "Yixu Shoukiyaki" and found that a dish made with Greenland halibut (Yong Flounder) was declared "Japanese grilled cod" on the menu.

After investigation, the operating body of "Yixu ShouxiYao" is Shanghai Fengzhixu Catering Management Co., Ltd. From May 1, 2020 to September 14, 2021, the company had the above problems at its "Ichisui Shoukiyaki" stores in the Shanghai area.

It is understood that Greenland carlibut (mediocre flounder) and cod belong to two different "orders", and there is no direct relationship between the two. On September 14, 2021, the company revised the menu by changing the name of the dish "Japanese Grilled Cod" to "Japanese Grilled Flounder".

Dishes made with Greenland flounder (mediocre flounder) claim to be "Grilled Cod" in violation of the Unfair Competition Act. On December 3, the Shanghai Yangpu District Market Supervision and Administration Bureau ordered Shanghai Fengzhixu Catering Management Co., Ltd. to stop its illegal acts and imposed a fine of 500,000 yuan.

Paragraph 1 of Article 8 of the Anti-Unfair Competition Law: Proprietors shall not make false or misleading commercial publicity about the performance, function, quality, sales status, user evaluations, and honors they have won on their goods, so as to deceive or mislead consumers.

The Shanghai Municipal Consumer Protection Commission believes that in the course of its daily business, the company took advantage of the lack of consumers' ability to identify the relevant food types to impersonate Greenland flounder (mediocre flounder) as Japanese grilled cod, which was shoddy and damaged the legitimate rights and interests of consumers, and should bear relevant liabilities. Regarding the issue of the company's civil liability, the Shanghai Municipal Consumer Protection Commission will follow up and intervene.
