Eight departments, including the Ministry of Transport: Drivers and vehicles that have not obtained a license are not allowed to join the online ride-hailing platform

Recently, the Ministry of Transport, the Ministry of Industry and Information Technology, the Ministry of Public Security, the Ministry of Human Resources and Social Security, the Chinese Bank, the State Administration of Taxation, the State Administration of Market Supervision and Administration, the State Cyberspace Administration and other 8 departments jointly revised and issued the "Notice on Strengthening the Work Related to the Joint Supervision of the Whole Chain of the Online Reservation Taxi Industry Before and After the Event". The Notice makes it clear that e-hailing platform companies may not access drivers and vehicles that have not obtained the corresponding taxi licenses.

It is understood that in order to implement the decision-making and deployment of the Party Central Committee and the State Council, in accordance with the work arrangements of the inter-ministerial joint conference on the coordinated supervision of new forms of transportation, combined with the new situation and new requirements for the development of the online ride-hailing industry, the Notice has improved the joint supervision of the whole chain of multi-departmental pre-event, post-event, and post-event, and refined the disposal measures and operational processes to facilitate the operation and implementation of relevant departments at all levels.

The main amendments to the Notice include: First, the addition of prior joint regulatory requirements. Relevant local departments are required to optimize service processes, strictly control industry access, and urge online ride-hailing platform companies not to access drivers and vehicles that have not obtained corresponding taxi permits.

The second is to improve the joint supervision of the whole chain. The online ride-hailing platform company will engage in business activities without obtaining an online ride-hailing business license; the online ride-hailing platform company will send orders to drivers and vehicles that have not obtained the corresponding taxi license and fail to transmit relevant data and information to the online ride-hailing supervision information interaction platform in accordance with regulations; there is low-price dumping, fraud, and unreasonable differential treatment of individuals in terms of transaction conditions; endanger network security, data security, and infringement of users' personal information rights and interests; illegal business funds payment and settlement; infringe on the labor protection rights and interests of online ride-hailing drivers; failure to pay taxes in accordance with law; endanger the public interest, Violations of laws and regulations in eight areas, such as disrupting social order and affecting social security and stability, are included in joint supervision work matters.

The third is to refine the joint supervision process of the whole chain. Subdivide the supervision process during and after the event into initiation, reporting, disposal and other links. Where there are serious violations of laws and regulations by an online ride-hailing platform company, and it still refuses to correct it after being handled in accordance with laws and regulations, the relevant departments of cities at the prefectural level and above may organize and initiate joint supervision after reporting to the local people's government, and report to the level step by step to request disposal measures such as ordering the suspension of business services in the region, suspension of the release or removal of APP, suspension of Internet services, suspension of networking or shutdown for rectification.
