First, the accident profile

At 8:50 on November 27, 2016, a pipeline explosion accident occurred at the construction site of a municipal pipeline (for pressure pipelines, hereinafter referred to as the pipeline) in the Construction Site of a municipal pipeline (hereinafter referred to as the pressure pipeline, hereinafter referred to as the pipeline) in the Construction Project Department of the High-tech Zone of XN City, causing 1 death, 1 injury, and direct economic losses of 1,541,922 yuan.

Second, the situation of pipelines and facilities

The Qinglong Road Renovation Project of XN High-tech Zone belongs to the auxiliary project of the urban infrastructure upgrading and transformation project of XN High-tech Zone (Phase I and Phase II), and is one of the 15 financing projects of XN High-tech Zone in the 2016 municipal government project investment plan with the consent of XN Municipal People's Government, and the Qinglong Road Reconstruction Project belongs to the road blacking project and supporting projects in the park. The project started construction on August 4, 2016, and the construction project was municipal road blacking project, municipal ancillary project and municipal landscaping project, and the construction permit has not been processed as required since the start of the project.

On November 27, 2016, the construction site where the accident occurred was the pipeline pressure test, which occurred at the construction site of the pipeline pre-buried project from 40m east of the intersection of Qinglong Road and Shutai Street to 160m west of the intersection, involving a pipeline length of about 200m. The pipe is made of HDPE drainage pipe, with an outer diameter of 400mm and a rated operating pressure of 1.0MPa. On November 16, 2016, the Civil Engineering Testing Center of Wuhan Huazhong University of Science and Technology tested the samples of the pipes, and the test results showed that they met the requirements of relevant standards and the quality of the pipes was qualified.

According to the design of the pipeline construction plan, after the pipeline is welded with hot melt, a hydrostatic test should be carried out before the pipeline is concealed. The specific requirements are: first fill the pipe with water and carry out thorough exhaustion, and then slowly raise the water pressure to the specified experimental pressure. The boost time shall not be less than 10min, and the voltage regulation shall be 1h.

3. Accidents

On November 25, 2016, a total of about 200m from 40m east to 160m west of the intersection of Qinglong Road and Shutai Street in XN High-tech Zone, the construction site of the high-tech project department used water code to carry out one-way enclosure and closure construction on the ongoing pipeline pre-buried construction site. Zeng Moukun's labor construction team completed the hot melt welding of nearly 200m of the pipeline in the road according to the project schedule, and prepared for pipeline embedding. According to the requirements of the construction plan, the water pressure test should be carried out before the pipeline pre-burial, and Shao Mou, the person in charge of the labor construction team, organized the completion of the hot melt welding of the plug on the east side of the pipeline, and after the welding of the pressed flange on the west side, the water pressure test was not carried out in accordance with the requirements of the plan, and the mobile tire repair shop owner town was temporarily hired to carry out the air pressure test.

At 17:40 on the 25th, the pressure began to be suppressed at the west end of the pipeline, and by 2 o'clock on the 26th, the pipeline gauge pressure showed 0.8MPa, and nearby residents reported that the noise was too large, and the labor construction team immediately suspended the construction.

At 14:00 on the 26th, the labor construction team once again called Zhen Mousong and continued to suppress it. At about 20 o'clock, the pressure of the pipeline gauge rose to 1.18MPa and then stopped. Shao pressed the on-site table to take a photo, and sent it to Ni Mouhui, a technician of the high-tech project department, through WeChat, ni Mouhui forwarded the photo to the supervisor Zhang Mou, who asked the on-site personnel to cover the valve and place the reflective cone after receiving the photo.

At 8 o'clock on the 27th, Shao went to the west side of the pipeline to check the pressure, and the gauge pressure was 1.17MPa. Then Shao found Ni Mouhui and asked him to go to the scene together to check. Ni Mouhui contacted Zhang by phone and prepared to go to see it together. At about 8:50, 3 people had not yet arrived at the construction site, the pipeline exploded, the west side flange flew out and hit the head of an electric tricycle driver (27 years old), causing him to die on the spot, and the fragments of the broken pipe flew out and smashed the leg of 1 passing crowd.

4. Accident direct cause

During the test of the pipeline, the construction personnel did not carry out the pressure test according to the requirements of the construction plan, and the test medium was changed from water to air in violation of the law. During the packing process of the pipeline, affected by the increase in ambient temperature, the pressure in the pipe rises sharply, exceeding the rated operating pressure of the material, resulting in a pipeline explosion accident.

Fifth, management issues

1． The safety production responsibility system of the project department of the high-tech zone is not implemented, the safety management system is not perfect, and the safety management and supervision and inspection are not in place. In violation of the provisions of Article 7 of the Construction Law of the People's Republic of China, construction began in August 2016 without a construction permit; there was no unified coordination and management of the safety production work of the construction unit, no safety inspection of the construction unit and the site, and the construction plan was not clear; the pipeline pressure test was started on November 25, and the construction site was not completely closed; and the construction unit's illegal construction behavior was not stopped and rectified without supervision and rectification when it was known that the labor construction team changed the test plan.

2． A construction engineering company in Hubei violated the provisions of article 9, paragraph 1 and article 13 of the "Measures for the Administration of Subcontracting of Housing Construction and Municipal Infrastructure Projects", failed to complete the subcontracted projects on its own, and directly issued all the subcontracted projects to Zeng Moukun, an unqualified contractor, and did not set up a project management agency at the construction site, did not appoint corresponding management and technical personnel, and did not organize and manage the project construction activities. The entrusted agent Liu Xiaoen did not have the safety management qualification of the construction project, and during the period of full responsibility for the management of the subcontracted project, he failed to perform the duties of on-site management and coordination, and did not supervise the rectification of the air pressure test at the construction site violations and did not stop it in time.

3． A construction project supervision company in Hubei Province, knowing that the water pressure test plan of the pipeline of the construction unit was changed to the air pressure test without authorization, did not examine whether the safety technical measures or special construction plans in the design of the construction organization met the mandatory standards for engineering construction. In the process of implementation supervision, it was found that there were hidden dangers of safety accidents, the construction unit was not required to rectify or temporarily stop the construction, the construction unit was not reported in time, and the relevant competent department was not reported in time. The project supervision unit and the supervising engineer did not supervise in accordance with laws, regulations and mandatory standards for project construction.

4． The labor construction team has no corresponding qualifications, the labor organization is unreasonable, the pressure test plan is changed without authorization, the safety operation procedures have not been formulated, the pressure gauge of the pressure test device has not been calibrated, the pressure test has not been tested, there is no safety technical precautionary measures, the operation is in violation of the law, and the safety protection measures such as warning signs and isolation belts have not been taken, and the safety education and training are insufficient.

5． The Market Supervision and Management and Comprehensive Law Enforcement Bureau of XN High-tech Zone did not conscientiously perform its duties, did not supervise and inspect in place, and cracked down on the violations of the construction unit without applying for a construction permit for construction and changing the construction plan without authorization.

VI. Suggestions for pursuing the responsibility of relevant units and personnel

(1) Relevant units

1． The project department of the high-tech zone started construction without a construction permit, the management of subcontracting units and construction sites was lax, the construction plan was not clear, the illegal construction behavior of the construction unit was not stopped in time, the safety production work of the contracting unit was not uniformly coordinated and managed, the safety inspection was not carried out regularly, and the safety problems were not promptly supervised and rectified. Responsible for the occurrence of accidents. In accordance with the provisions of Item 1 of Article 109 of the Work Safety Law of the People's Republic of China, it is recommended to give an administrative penalty of a fine of 200,000 yuan; it is recommended that the Market Supervision and Management and Comprehensive Law Enforcement Bureau of the Management Committee of XN High-tech Zone immediately order the high-tech project department to suspend construction.

2． A construction engineering company in Hubei violated the provisions of the "Measures for the Administration of Subcontracting of Housing Construction and Municipal Infrastructure Projects", did not complete the subcontracted projects on its own, directly subcontracted the subcontracted projects to the unqualified contractor Zeng Moukun, did not set up a project management agency at the construction site, did not dispatch corresponding personnel, did not organize and manage the construction activities of the project, and was responsible for the occurrence of the accident. In accordance with the provisions of Item 1 of Article 109 of the Work Safety Law of the People's Republic of China, it is recommended to give an administrative penalty of a fine of 200,000 yuan.

3． A construction project supervision company in Hubei did not review the construction unit's unauthorized change of the pipeline pressure test plan, found that the hidden dangers of safety accidents did not require the construction unit to rectify or temporarily stop the construction, did not report to the relevant competent departments in time, and failed to supervise in accordance with laws, regulations and mandatory standards for project construction. It is responsible for supervising the occurrence of accidents. In accordance with the provisions of Article 57 of the Regulations on the Administration of Work Safety in Construction Projects, it is recommended to give an administrative penalty of a fine of 100,000 yuan.

(2) Relevant personnel

4． Liu Mou, the project executive manager of the high-tech project department, did not coordinate and manage the safety production work of the project subcontracting unit, did not guide and supervise the safety management personnel of the project department to inspect the on-site work, did not timely discover and rectify the hidden danger of unqualified personnel contracting subcontracting projects, and was responsible for the occurrence of the accident. In accordance with the provisions of Article 92, Item 1 of the Work Safety Law of the People's Republic of China, it is recommended that the High-tech Project Department give corresponding treatment.

5． Li Moushun, director of the Safety Supervision Department of the High-tech Project Department, failed to perform his responsibility for safe production, did not organize a safety inspection of the construction site of the contracting unit, did not find hidden dangers in time, neglected supervision and management of the safe construction of the contracting unit, neglected to supervise the construction unit's unauthorized change of the pressure test plan, and had the responsibility for supervising the occurrence of the accident. It is suggested that the high-tech project department give Corresponding treatment to Li Bishun.

6． Li Mouhui, the legal representative of a certain construction engineering co., LTD. in Hubei, a project subcontracting unit, in the process of performing the road surface auxiliary construction subcontract of the urban infrastructure upgrading and transformation project in the XN High-tech Zone, lacked inspection of the construction unit site, and the hidden danger supervision and rectification was ineffective, entrusted personnel without construction project management qualifications to carry out construction and construction management, and had leadership responsibility for the occurrence of the accident. In accordance with the provisions of Article 92, Item 1 of the Work Safety Law of the People's Republic of China, it is recommended to give an administrative penalty of a fine of 30% of the previous year's annual income.

7． Liu Mouen, the fully entrusted agent of a construction engineering co., LTD. in Hubei, a subcontracting unit of the project, does not have the qualification of construction project management, and during the entrustment period, he did not perform the on-site management and coordination duties, and was responsible for the occurrence of the accident. It is recommended that a construction engineering company in Hubei give corresponding treatment.

8． Zhao Mouqiang, Supervision Engineer of a Construction Engineering Supervision Co., Ltd. in Hubei Province, Director of Integrated Supervision Service Project for Urban Infrastructure Upgrading Project Construction in XN High-tech Zone. Failure to organize review and deal with changes in the accident engineering test plan, and responsibility for the occurrence of the accident. In accordance with the provisions of Article 58 of the Regulations on the Administration of Work Safety in Construction Projects, it is recommended that the housing and construction department give an administrative penalty of ordering it to stop practicing for 3 months.

9． Zhang Mou, supervision engineer of a construction project supervision company in Hubei Province, supervisor of integrated supervision service project for urban infrastructure upgrading project construction in XN High-tech Zone. After it is found that the construction party has changed the construction plan, it has not issued a stop or rectification instruction, and has direct supervision responsibility for the occurrence of the accident. In accordance with the provisions of Article 58 of the Regulations on the Administration of Work Safety in Construction Projects, it is recommended that the housing and construction department give an administrative penalty of ordering it to stop practicing for 3 months.

10． Shao Mou, the person in charge of the labor construction team. Failure to obtain the qualification of the person in charge of the construction site to manage the construction site, and not to carry out pipeline pressure tests according to the construction plan, is responsible for the occurrence of accidents. It is recommended that the labor construction team handle it.

11． Huang Moupeng, a technician of the Market Supervision and Management and Comprehensive Law Enforcement Bureau of XN High-tech Zone, is responsible for the on-site management of the upgrading and renovation project of Qinglong Road, and is overtepping the illegal construction behavior of the project in starting construction without applying for a construction permit. During the construction of the pressure test in the pipeline organization, it did not go to the scene for inspection, did not timely find that the construction unit changed the construction plan without authorization and made further treatment, and had the responsibility for supervising the occurrence of the accident. In accordance with Articles 10 and 13 of the Interim Measures for the Shared Responsibility of the Party and Government of Hubei Province, it is recommended that a written inspection be ordered.
