Timely early warning and precise strikes
Since November 2021, Qingpu, Minhang and other areas of the city have received a number of police reports involving vehicle leasing disputes, which reflect the common characteristics of "short-term breach of contract, short-term failure of leased vehicle, and high liquidated damage deposit charged by lessor". After visiting the police one by one and verifying the facts of the case, the police found that this type of police situation is different from the general contract dispute, and the preliminary judgment is a new type of fraud criminal method.
Accordingly, the Criminal Investigation Corps of the Municipal Public Security Bureau adhered to the concept of "concentrated crackdown on similar crimes, deepening of organized crime, and attacking new types of crimes", and quickly guided the Qingpu Public Security Sub-Bureau to detect 3 new types of fraud cases of "routine car rental". On December 7, the joint task force launched the first round of concentrated crackdown operations, successfully destroying a number of "routine car rental" fraud gangs.
After the first round of operations, the Criminal Investigation Corps immediately summarized the characteristics and key points of such new fraud methods, and carried out a full multi-dimensional study and judgment of similar police situations in the city and telephone return visits. Since December 10, we have led the Baoshan, Songjiang, Minhang, Qingpu and other public security sub-bureaus to carry out the second round of citywide centralized network collection operations in depth, changing "local sanda" into "city-wide heavy punches".
Up to now, the police have destroyed 19 "routine car rental" fraud gangs, arrested more than 190 criminal suspects, seized vehicles, scripts, contracts, computers and other crime tools involved in the case, and the amount involved is more than 15 million yuan, effectively deterring criminals.
Trap clause Routine scam
After investigation, this kind of "routine car rental" new type of fraud crime is disguised as "company operation and signing of contracts", showing the characteristics of fast updating and strong concealment of the modus operandi, and the internal division of labor and responsibilities of the car rental company involved in the case is clear, mainly composed of 4 criminal links:
The first is false advertising diversion. False advertisements for high-paid drivers are published on Internet recruitment websites and social platforms in the hometown groups and circles of friends to attract migrant workers to the company for interviews and applications.
The second is to set up a set of contracts. Elaborate speech scripts, induce migrant workers to form the wrong perception of "easy to obtain high income" during interviews, and urge migrant workers to sign and pay deposits ranging from 5,000 to 10,000 yuan without fully knowing the content of the contract for various reasons.
The third is to deliberately create a breach of contract. Deliberately creating breaches of contract by deliberately creating scratches, artificially creating accidents, installing equipment without power and receiving cars, accusing renters of not complying with car specifications, and concealing harsh operating indicators.
The fourth is to forcibly take the deposit. After the renter defaults, the fraud gang forcibly takes the "contracted" service fee, deposit, rent and other expenses to illegally make profits.

In the "routine car rental" fraud, no matter what method the criminal gang takes to deliberately create or force the renter to take the initiative to default, it is to quickly recover the vehicle, and then achieve the ultimate purpose of illegally taking the renter's deposit. Accordingly, the police remind the general public that if they intend to engage in the work of online ride-hailing drivers, they should take the initiative to understand the qualification requirements of relevant industries, and apply for contracts with qualified regular companies or platforms, and the qualifications of the company or platform can be queried through the open channels of the relevant administrative departments.
To improve the awareness of prevention, we should sign a legal and compliant labor contract and carefully read and fully understand the content of the terms, especially some clauses with conditions attached, involving deposits or liquidated damages, pay special attention to and do a good job of screening, and effectively protect their legitimate rights and interests. After signing the contract, pay attention to checking the condition, appearance, and driving license of the vehicle you are driving, and comply with traffic laws and operating norms.
