Frequent cases of loan fraud

In March 2020, Ms. Gu, who lives in Zhangjiagang City, Jiangsu Province, accidentally saw a link to a loan software pop up on her mobile phone, and as long as she uploaded an ID photo and opened the mobile phone address book permission, she could take out a loan within a few seconds. Because Ms. Gu was in urgent need of money at that time, she entered the information without much thought, but she did not expect to borrow 3,000 yuan, and only 1,650 yuan was in hand.

What is even more puzzling to Ms. Gu is that while she was still repaying, this loan software suddenly and automatically disappeared from her mobile phone. Later, a stranger suddenly contacted her, sent her a bank account, and informed her to repay the money within the time limit, otherwise she would have to spread the loan to the people in her mobile phone address book.

Not only that, but people on lending platforms also raise interest rates for various reasons. Because Ms. Gu borrowed 3,000 yuan, she finally repaid a total of more than 6,000 yuan. Feeling that something was wrong, Ms. Gu decided to call the police.

When the police combed through the cases, they found more than one similar report. In the same month that Ms. Gu reported the crime, a man named Tang Tao (pseudonym) also said he had been cheated by a loan software. But unlike Ms. Gu, when Tang Tao entered the information and did not finalize the loan operation, the software automatically made a decision for him and directly hit the loan into his bank account.

After that, Tang Tao suffered a similar debt collection experience as Ms. Gu. After he borrowed four loans, he finally realized that he had been deceived and quickly called the police.

According to the preliminary analysis of the police, behind these two cases is the same criminal gang, both using usurious lending software, using low interest rates as bait, first attracting people to install illegal apps, deducting high handling fees and then lending, and then using the address book collected in the victim's mobile phone to harass and threaten the victim or his relatives and friends to ask for "debts". During the investigation, the police also noticed that there were more than a dozen similar cases in the local area within a month, and they speculated that this may be a major case that has spread to the whole country.

Illegal payment platforms

The task force analyzed the victims' transfer records and found that their money was sent to the account of a company suspected of money laundering in Hangzhou, Zhejiang Province, and then the company transferred the money to a private bank card. After investigation, the cardholder's name is Xue Yi (pseudonym), and he is from Wenzhou City, Zhejiang Province. At the end of April 2020, police arrested Xue Yi in Ruian City, Wenzhou City, Zhejiang Province.

Xue Yi confessed that after he collected the funds collected by the money laundering company, he transferred the money again to the owner behind him through an illegal payment platform called "Fire Bull".

After analyzing the "Fire Bull" platform, investigators found that this illegal payment platform aggregated more than 100 illegal software involving online loans and telecommunications fraud across the country, and the specific location of the platform's servers was set up in Da Nang, Vietnam and Kokang Old Street, Myanmar. Through digging deeper, the police locked down Liu Feng (pseudonym) in Myanmar and determined that he was responsible for the maintenance and operation of the "Fire Bull" platform.

Police analyzed Liu Feng's social network and found that Liu Feng and Yuan Han (pseudonym) were in close contact. After investigation, Yuan Han worked as an architecture engineer at a communications company in Hangzhou, Zhejiang Province, and the "Fire Bull" platform needed strong architectural capabilities, and the police speculated that Yuan Han had a major suspicion of committing a crime.

The police destroy the fraud gang

On April 28, 2020, the police of the special case group divided into multiple roads and closed the net in Guangdong Province, Zhejiang Province and Sichuan Province, respectively, and arrested Yuan Han and 22 other people. On May 27, 2020, Liu Feng and seven other overseas personnel also returned to China and surrendered themselves.

After Liu Feng arrived at the case, he said that he and Yuan Han had a good relationship and were college classmates. After graduating with a bachelor's degree, Liu Feng worked in Hangzhou, Zhejiang Province, while Yuan Han continued his studies and then stayed in Hangzhou, Zhejiang Province as an architecture engineer.

Later, by chance, Liu Feng met a boss. He gave Liu Feng a huge amount of money to let Liu Feng develop an aggregation platform with instant messaging, payment and other functions. Therefore, Liu Feng thought of asking Yuan Han for help.

At this point, this fraud gang that uses mobile phone apps to implement routine loans has been completely destroyed. The police arrested 81 suspects, seized more than 50 million yuan, more than 30 computers, more than 100 mobile phones, 3 cars, and froze and seized more than 1,000 bank settlement cards.

On June 21, 2021, the Public Security Bureau of Zhangjiagang City, Jiangsu Province, transferred Yuan Han, Liu Feng, and others to the Zhangjiagang Municipal People's Procuratorate in Jiangsu Province for review and prosecution. On July 30, 2021, the People's Procuratorate of Zhangjiagang City, Jiangsu Province, filed a public prosecution with the Zhangjiagang Municipal People's Court of Jiangsu Province on suspicion of yuan Han, Liu Feng, and others for the crimes of illegal business operations and aiding information network criminal activities.

Q1: What are the characteristics of such telecommunications fraud cases that use mobile apps to lend usuriously?

A1: The first is convenience. Very convenient and fast, you can get off the model in a few seconds. The second is that it is deceptive. Strictly speaking, arbitrage loans are not standard legal concepts, and only arbitrage loans that meet the constituent elements of the crime of fraud constitute fraud. What is fraud? That is, fictitious facts, so that the victim falls into a mistake of understanding, and based on the error of understanding, the victim disposes of the property, and finally the perpetrator obtains the property, and the victim suffers property damage. In this case, the perpetrator concealed the high amount of kickbacks and handling fees, and the victim did not know that there was such a high handling fee, fell into a cognitive error, and finally not only had to repay the high interest, but also had to repay the principal in full. The third is mandatory. It forced the next payment, and before the victim had decided to borrow money, these software made a decision for the victim, which was very compulsive. The fourth is intimidation. Upload your ID card and open the mobile phone address book permissions. The ID card is not afraid of the victim running, and the address book can be used to blackmail and harass the victim's relatives and friends. So these four characteristics are typical of this type of case.

Q2: How can we prevent this new type of telecommunications fraud?

A2: The virtual world is not warmer than the real world, in the online world or to cultivate a certain sense of anti-deception, encounter things or or discuss with relatives and friends, listen to everyone's opinions and then make a decision. Think twice about everything, so be careful to choose this kind of borrowing channel to choose a formal and secure large platform. Before borrowing, you should also measure your repayment ability, and do not over-consume to cause financial crises. When borrowing, pay special attention to the terms of the contract, especially some key terms, such as liquidated damages, interest, handling fees, etc., and ask more questions where they are not clear. When encountering problems, you should call the police in time to prevent them from getting deeper and deeper.

Q3: So how do we see that high-end technical talents such as Yuan Han and Liu Feng (pseudonyms) were finally used by criminal gangs?

A3: This kind of technology can certainly promote the development of this kind of society, but if it is used in evil ways and used to aid criminals, then it is a criminal tool. So Gan said, "There are seven things that can destroy mankind, one is the knowledge of right and wrong, and the other is the science without humanity." "So technology has never been value-neutral. If a technology is mainly to provide assistance and assistance to criminals, then this technology is punishable. That is why the Criminal Law Amendment (IX) of 2015 provides for the offence of aiding information cybercriminal activities. Then you know that others are scamming, but also provide them with network technical support, in fact, can constitute this crime, technology neutrality is not a shield for crime.
