The reporter learned from the Supreme People's Procuratorate on May 9 that in order to meet the needs of the development of legal supervision of procuratorial organs in the new era and further improve the level of specialization and standardization of procuratorial technical work, the Supreme People's Procuratorate recently issued the "Opinions on Strengthening Procuratorial Technical Work in the New Era" (hereinafter referred to as the "Opinions").
The "Opinions" are guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, thoroughly implement Xi Jinping Thought on the Rule of Law, focus on strengthening the legal supervision of procuratorial organs, with inspection and appraisal, special review of technical evidence, and technical assistance as the main responsibilities, improve work models, coordinate resource allocation, strengthen team building, provide evidence and technical support for procuratorial case handling, and serve high-quality and efficient procuratorial performance and case handling.
The "Opinions" pointed out that the role of procuratorial technical functions should be brought into full play in procuratorial supervision and case handling. Strengthen inspection and appraisal work, strengthen the evidentiary support role of inspection and appraisal in procuratorial investigations, and give play to the role of inspection and appraisal in the investigation and verification of public interest litigation and the judgment of litigation claims. Expand the scope of support for inspection and appraisal for evidence verification in litigation supervision cases. Strengthen efforts to specifically review technical evidence, give full play to the role of procuratorial technology in assisting oversight and correction of errors, comprehensively review major and difficult cases and technical evidence where there are controversies and differences, and conduct regular analysis of operational data such as the review rate and acceptance rate of technical evidence. Strengthen procuratorial technical assistance work, standardize on-site inspection and evidence collection work, and improve procuratorial organs' work rules for on-site inspection and evidence collection. Strengthen the application of technologies such as rapid detection, big data, and remote sensing in the discovery and screening of clues in procuratorial oversight and case handling. Deepen the application of technologies such as handwriting screening, forensic accounting examination, and psychological testing. Strengthen procuratorial technology support for procurators appearing in court to debate evidence and procuratorial hearings.
The "Opinions" emphasize that it is necessary to improve the procuratorial technical work system and make overall plans for the use of procuratorial technical resources. Procuratorial organs at all levels persist in their professional needs, rationally arranging procuratorial technical institutions, setting up procuratorial technical specialties with special characteristics, and rationally allocating procuratorial and technical personnel. Give full play to the advantages of procuratorial integration, make overall plans to strengthen the use and management of procuratorial technical resources, and strive to improve the quality and efficiency of procuratorial technical work.
The "Opinions" require that organizational leadership be strengthened and the level of specialization and standardization of procuratorial technical work should be improved. Party groups of procuratorates at all levels should plan and promote procuratorial technical work from the perspective of ensuring high-quality and efficient case handling and advancing the modernization of procuratorial work, regularly hear reports on procuratorial technical work, and coordinate the resolution of difficulties and problems encountered. Strengthen the construction of specialization, build a talent training mechanism that conforms to the characteristics of the procuratorial technology profession, and carry out special training on professional and technical qualifications and appraisal qualifications. Establish a procuratorial technical talent pool and establish a system of key laboratories for procuratorial organs. At the same time, attention should be paid to strengthening the standardization of procuratorial technical work, strengthening work guarantees, and strengthening the building of a clean and honest party style.
