"Edible alum" was added to fritters in excess, and the owner of the snack bar was sentenced and fined

It turned out that the fritters he sold had an excessive amount of "edible alum" added to it. Today, the reporter learned from the Furong District People's Court of Changsha City that the owner of the snack bar was sentenced for the crime of producing and selling food that did not meet safety standards, and was also fined.

Since September 2020, Mr. Jin has operated a snack bar in a store in Xinqiao Qinyuan Community, Furong District, Changsha City, making fritters for sale. In order to increase the selling appearance of fritters, Jin Moumou purchased edible alum and added them to the fritters according to the standard of 10 kg of flour ratio 8 grams of alum. To the occurrence of the case, Jin Moumou made 350 fritters with "edible alum" added, and the sales amount totaled 700 yuan.

On September 12, 2020, the law enforcement personnel of the Furong District Market Supervision and Administration Bureau conducted sampling tests on the fritters produced and sold by Jin Moumou and found that the residual amount of aluminum in the sampled fritters was 845mg/kg, which greatly exceeded the requirements of the "National Standard for Food Safety and the Standard for the Use of Food Additives" (standard index ≤100mg/kg), which was unqualified food.

Subsequently, the Furong District People's Procuratorate held that Mr. Jin produced and sold food that did not meet safety standards, endangered the health and safety of many consumers, and harmed the social public interest, and planned to file a public interest lawsuit, which was announced on the "Justice Network" on April 18, 2021, with an announcement period of 30 days; the announcement period expired, and no organs and relevant organizations stipulated by law gave feedback and filed a lawsuit. The Furong District People's Procuratorate of Changsha City then filed a criminal attached civil public interest lawsuit with the Furong District People's Court. After the incident, Jin actively handed over 700 yuan of illegal gains and took the initiative to pay punitive damages of 7,000 yuan.

After trial, the Furong District People's Court convicted Jin X of the crime of producing and selling food that did not meet safety standards, sentenced jin X to five months' detention, suspended sentence for ten months, and fined him 10,000 yuan; prohibited Jin X from engaging in food production and business activities during the probationary period of probation; and at the same time ordered Jin X to publish a statement of apology approved by the court in the news media at or above the provincial level in Hunan Province within 10 days after the judgment took effect.
