[News-Oxcart Network]

Xiaopeng Automobile, which has won the crown of the new car-making force for two consecutive months, was recently pushed into the hot search by a punishment announcement.

It is reported that Shanghai Xiaopeng Automobile Sales service Co., Ltd. was fined 100,000 yuan by the Xuhui District Market Supervision and Administration Bureau, according to the content of the penalty decision, the parties purchased 22 camera equipment with face recognition functions, and the hardware and software procurement fees totaled 173,800 yuan, and all of them were installed in its stores, involving 5 direct stores and 2 franchise stores. From January to June 2021, the above-mentioned face recognition camera equipment collected a total of 431623 faces.

Shanghai Xiaopeng Automobile Sales and Service Co., Ltd. was fined 100,000 yuan for infringing on consumers' personal dignity, infringing on consumers' personal freedom or infringing on consumers' personal information.

It is understood that the camera equipment involved in this incident comes from the supplier Yoroko, and this familiar name was named at the CCTV 3.15 evening party this year for illegally collecting face information. U-Rook immediately apologized for this and claimed that it was willing to fully respect the security of users' personal information, accept the supervision of society and media, and the rectification opinions of law enforcement agencies.

Some people may question that from being exposed by CCTV in March to collecting face data in the store involved in Xiaopeng Automobile in June, the time difference is as long as three months, is Xiaopeng Automobile ignorant of this?

After the incident was exposed, Oxcart Also contacted Xiaopeng Motors for the first time and obtained an adjusted response version 2.0 (the following is part of the content):

In this incident, the stores in the Shanghai area from January to March this year hoped to improve the reception process and better serve the customers who arrived in the store through the collection and analysis of data such as the customer flow of the store, and mistakenly purchased and used the products of third-party suppliers (Yoroker) who violated the relevant legal provisions. Xiaopeng Motors does not disclose or illegally use personal information, and only uses non-personally related digital data such as passenger flow visits as a reference for business conditions.

(Xiaopeng Automobile) After the store pointed out the relevant problems at the CCTV 315 evening, it immediately took the initiative to remove all collection equipment through self-examination and self-correction on March 18.

In the follow-up investigation of the Market Supervision Administration, it actively cooperated with the submission of non-personally related digital data such as passenger flow analysis data provided by the software during the specified survey period (January to June) and from 1/1 to 3/18. Facial recognition data involving personal information is deleted by third-party suppliers under the supervision of the Market Supervision Administration.

The response was indeed more sincere, and also explained in detail the timing and specific content of the incident. However, under careful reading, we found that in fact, the store involved was purchased in a dignified manner under the condition that the camera equipment was known to have the function of collecting data, and when the self-examination and self-correction afterwards, more than 430,000 face data had been collected and analyzed. Although the data collection has not caused serious consequences for the time being, consumers' personal information has still been leaked, as stated in the administrative penalty decision, which has violated the Consumer Rights protection law.

In the Personal Information Protection Law, which just came into effect on November 1, biometric information has been classified as sensitive personal information, and further emphasizes the requirement of installing image collection and personal identification equipment in public places, which should be necessary to maintain public safety, comply with relevant national regulations, and set up conspicuous prompt signs.

Yoroko is not a first-time offender, so is Xiaopeng Automobile only a store in the Shanghai area that has been "brutally killed"? As of September 30, 2021, Xiaopeng Automobile's sales stores have reached 271, covering 95 cities across the country, in addition to the 7 stores involved in this incident, the other 264 stores are safe and sound? Xiaopeng Automobile told Oxcart That in the process of self-inspection and self-correction, it has been confirmed that except for the seven stores involved, the rest of the stores have not had this situation.

According to the latest financial report of Xiaopeng Motors, in the third quarter of this year, Xiaopeng Motors' revenue reached RMB5.72 billion, an increase of 187% year-on-year; the net loss reached RMB1.59 billion, further expanding the amount of loss. Performance falls into the strange circle of "increasing revenue without increasing profits", mainly due to R&D investment and channel expansion. The exposure of this penalty decision also sounded the alarm bell for Xiaopeng Automobile, which has been soaring all the way, and it is reasonable for enterprises to hope to improve their business conditions, but they should not be at the expense of infringing on consumers' personal information.
