On February 22, Shanghai's first "Guidelines for the Specification of "Scanning Codes and Ordering Food" in the Catering Industry" (hereinafter referred to as the "Guidelines") was officially released to guide operators to regulate relevant behaviors.

Proprietors must not forcibly or excessively collect personal information

"Excessive collection of consumer information mainly occurs in the three links of ordering, payment, and obtaining discounts." He Jian, head of the regulatory department of the Xuhui District Market Supervision Bureau, said that many consumer complaints reflect that if personal information such as mobile phone numbers and WeChat accounts are not registered or authorized after scanning the code, these three links cannot be carried out smoothly.

There are also consumers who reflect that when ordering food in different stores under a chain catering brand, they found that the personal information registered in a store before was shared with other stores without consent, and it seemed that it was convenient to go to other stores to order food, but when you think about it, you are afraid.

Therefore, the Guidelines make it clear that catering service operators collecting consumer information shall follow the principles of legality, legitimacy and necessity, and when providing scanning code ordering services, they shall be limited to the minimum scope of achieving the purpose of processing, and consumers shall not be compulsorily required to register or authorize personal information such as mobile phone numbers and WeChat accounts, and consumer information shall not be excessively collected.

Where catering service operators attract consumers to register or authorize through discounts or preferential treatment, they shall separately obtain consumer consent and must not be bundled with the scanning code ordering service. Where stores in a chain catering service industry share consumers' personal information, they shall inform consumers of the scope of sharing and explicitly obtain consumers' consent.

Violation of the regulations or will bear legal responsibility

Although the Guidelines are not mandatorily binding, they integrate the provisions of relevant laws and regulations such as the Consumer Rights and Interests Protection Law and the Personal Information Protection Law, and business operators will bear legal liability if they violate relevant regulations.

The Guidelines make it clear that catering service operators must keep the collected consumer information strictly confidential and must not leak, sell or illegally provide it to others; without the consent or request of consumers, or if consumers explicitly refuse, they must not send commercial information to them.

Where business operators illegally collect consumers' personal information, the market supervision department will investigate and deal with them in accordance with the Consumer Rights and Interests Protection Law and other laws and regulations.

The Law on the Protection of Consumer Rights and Interests stipulates that where business operators infringe upon consumers' right to lawful protection of their personal information, and the laws or regulations do not provide for it, the administrative department for industry and commerce or other relevant administrative departments shall order corrections, and may, on the basis of the circumstances, give a single or concurrent warning, confiscate the illegal gains, impose a fine of not less than one time but not more than ten times the illegal gains, and if there are no illegal gains, impose a fine of not more than 500,000 yuan; if the circumstances are serious, order the suspension of business for rectification, and revoke the business license.

Operators are encouraged to retain traditional methods

The Guidelines also create some guiding suggestions in terms of anti-waste and ageing. For example, catering service operators should post or place anti-food waste signs in a conspicuous position, or remind consumers to prevent food waste through the interface of scanning code ordering, or when providing scanning code ordering services, the service personnel should prompt and explain, and guide consumers to order appropriate amounts of food on demand.

In view of the unreasonable practice of some catering stores only providing scan code ordering, the Guidelines encourage catering service operators to retain traditional methods such as physical menus, manual ordering, cash payment, etc., and use diversified services to facilitate various types of consumers.
