The mother had died, but the son told the judge dignifiedly that the mother was still alive, but she was unable to move and could not attend the trial. Recently, in an inheritance dispute case, the Fangshan Court in Beijing imposed judicial sanctions against the misrepresentation of the man Mr. Li's deceased mother.

On December 1, 2020, Mr. Li filed a civil complaint with the Fangshan Court in the name of Ms. Gao. Mr. Li is the son of Ms. Gao, and he wants to sue the five Song brothers on behalf of his mother. According to the prosecution materials, in 2010, Ms. Gao and Mr. Song were married, and the two belonged to the second marriage. Before remarriage, Mr. Song had five children. In 2014, due to the transformation of the shantytown, Mr. Song was given a set of relocated houses, with a house value of 400,000 yuan. In January 2018, Mr. Song made a will, and after his own death, the property was inherited by Ms. Gao.
In July 2020, Mr. Song died of illness. Mr. Song's five children did not approve of the will and did not agree to inherit the property to Ms. Gao. Therefore, Mr. Li sued the five brothers of the Song family in the name of his mother, Ms. Gao, and requested the court to judge the house involved in the case to Ms. Gao to inherit. After the case was filed, the Fangshan court served the five defendants with copies of the complaint, evidentiary materials and summonses in accordance with law. After receiving the litigation materials, all five defendants said that the plaintiff, Ms. Gao, had died.
On March 4, 2021, the Fangshan Court held a hearing on the case. Before and after the trial, the judge repeatedly asked Mr. Li about the physical condition of his mother, Ms. Gao, and explained the legal consequences of court discipline and misrepresentation. But after the trial, Mr. Li's behavior was unusual. Mr. Li had to tell the presiding judge that his mother had just died before the court opened the case.
Mr. Li said his mother also died three months after the death of his stepfather, Mr. Song. At that time, I was busy with funerals and did not have time to deal with the inheritance of real estate. Later, he was afraid that he did not have the right to fight for his mother, so he hid the news of her death from the court. The Fangshan court held that after Ms. Gao's death, Mr. Li still filed a lawsuit with the court in her name, which constituted a false statement, violated the principle of good faith in civil litigation, hindered the people's court from ascertaining the facts of the case, interfered with normal judicial order, wasted judicial resources, and his conduct had hindered civil litigation.
The judge hereby reminds that litigation participants participating in civil litigation should abide by court order, truthfully state the facts, must not falsify or alter evidence, obstruct the people's courts from trying cases, strictly abide by the principle of honesty and trustworthiness, and abide by the core socialist values.
