Procedural Justice and the "Trial of the Century" – Rugby Star Simpson's Alleged Murder (1)

author:HengNian Law Firm 824

The alleged murder of football superstar Orenthal James Simpson shocked the nation and was one of the most controversial cases of the century in American society of the 20th century. Many people believe that Simpson is so rich that he has spent a lot of money to hire the "Dream Team", which claims to be invincible in the world, to exonerate himself. Relying on their three-inch tongue, these lawyers took advantage of the racial contradiction in American society and loopholes in criminal proceedings to refute the "mountain of bloody evidence" prosecutors and police witnesses, and finally persuaded all members of the jury to acquit the murderer. This "Trial of the Century," which has attracted the attention of the global media for a while, is undoubtedly a great satire and ridicule of the US judicial system.

However, many years later, according to the published files of the Simpson case and the recollections of the parties involved in the case, people were surprised to find that the Los Angeles City police failed to strictly follow due process in the course of investigating the case, and a series of serious mistakes occurred, which enabled Simpson's legal team to prove to the jury with relatively sufficient evidence that Simpson was not necessarily the culprit of the murder, and it was very likely that some people would forge incriminating evidence and use the method of planting bribes to blame Simpson.

■ First, having money may not be able to make the ghost grind

Speaking of Simpson's case, both black and white admit that if Simpson is a poor egg who can't afford to hire a first-class lawyer, he has to go to jail. This is called "having money can make ghosts grind", which is a theory in ancient and modern China and abroad.

However, if you think about it carefully, this theory seems to be a bit unreasonable. The reason is that when it comes to money, the famous boxing champion Mike Tyson is much richer than Simpson, who has been out of the sports world for many years, but after Tyson was prosecuted for rape in 1997, although he also spent astronomical money to hire a group of lawyers to defend himself, he still could not get rid of the fate of being convicted, and squatted in prison for several years.

So why did Tyson fall into the net of justice while Simpson get away with it? One explanation is that the jury in Tyson was predominantly white, while the members of the Simpson jury were mostly black. Black people are particularly grouped, and they will naturally favor black stars.

However, this statement is also not entirely convincing. Because although 9 of the 12 jurors in the Simpson case were black, 8 of them were women. Some experts who have studied the jury argue that this composition is particularly detrimental to Simpson. According to the statistics and surveys conducted by American scholars on the sociological topic of "what kind of black men black women hate the most," there are two kinds of black grandfathers who are most angry with black women: one is the burning bun that immediately marries a white girl as a wife after becoming famous and rich, and the other is the rough man who punches and kicks his daughter-in-law without moving. And Simpson happens to take advantage of both of these bad things.

Simpson was born in 1947 in San Francisco to a poor black family. He has won the Highest Honor Award in the National College Football League, the Heisman Award. After entering the pro league, he played for the Buffalo Bills in New York and then the San Francisco 49ers, setting a stunning record of 2003 yards with the ball in one season (which has not been broken) and being hailed as the best running forward in the history of professional football. After retiring from sports, Simpson went on to work in film, television and advertising, starring in the films Naked Gun and Killer Force, as a sports commentator at ABC and NBC, and as an ambassador for Hezz, the largest taxi company in the United States. Also, since the abbreviation of the Word Orange Juice in English happens to coincide with the abbreviation of the Simpson name "OJ." So a Florida beverage company specifically invited him to shoot a promotional ad for orange juice that made "O.J." This English abbreviation became synonymous with American sports heroes and super advertising stars.

Simpson's fame has always had a reputation for "playboys" and "black and white outside". Unlike famous black stars such as Trapeze Artist Michael Jordan and Magic Johnson, Simpson has no interest in sponsoring black slum activities and investment projects, but is keen to join the wealthy white golf club. With the exception of his young friend Collins, his buddies were all white. At the same time, he also only has a "sexual interest" in white sexy girls. In order to "get rid of the black," he even went so far as to hire a speech correction expert at great expense, practiced repeatedly, and changed his thick black slum accent. In 1977, Simpson fell in love with Nicole Brown, a beautiful, blonde white waitress, at a fine dining restaurant and soon divorced his first black wife. After Simpson married Nicole in 1985, the relationship began to crack after Nicole suspected that he had a "second milk" outside. Nicole had called the police several times accusing Simpson of punching and kicking her.

After the Simpson case, several black female jurors repeatedly said that they did not influence the verdict because the defendant was black, or had any personal affection for the defendant. After becoming famous and rich in money, Simpson's dismissal of his black wife and the marriage of a white blonde greatly hurt the self-esteem of black women across the United States, and Simpson's rough behavior of scolding white wives made all women all over the world, regardless of skin color, shudder. In addition, in the trial of criminal cases in the United States, as long as 1 in 12 jurors has a disagreement, there will be a "dead lock" phenomenon, that is, the so-called "Hanging Jury" (Hung Jury) - in this case, the court will re-set the date of the trial, and the prosecution and defense will re-select the juror to hear and try the case. Therefore, the unanimous verdict of the defendant's innocence by the jury in the Simpson case has no absolute and inevitable relationship with the fact that the black person constitutes the main body of the jury.

So, on what basis did the jury reach a unanimous conclusion that the defendant was innocent? Under U.S. law, the sole basis for a judgment can only be evidence. The United States is a country with open administration of justice, and not only are criminal trials open to the public, but also the original archives of major criminal cases, such as court records, indictments, witness confessions, interrogation records, circumstantial evidence, forensic appraisal documents, and opening and concluding statements of procuratorial and defense lawyers, must all be open to the public after the case is concluded. According to the released files of the Simpson case, the jury's acquittal of Simpson is directly related to the major mistakes made by the police and the prosecution in the process of handling and initiating the case, which made the evidence presented unconvincing.
