Recently, a man came to the Chen Guanying Court of the Xigu District Court and personally handed over a pennant with the words "With the heart of loving the people, doing things that benefit the people" to the judge who undertook the case. He said that he should thank the court for its fair judgment, and even more for the court's efficient trial and solve his urgent needs.

The man, surnamed Wang, was the plaintiff in a lease contract dispute heard by the Xigu District Court. Since October 2010, Mr. Wang and Mr. Chen, the defendant in this case, signed a land lease contract, stipulating that Mr. Chen would lease to Mr. Wang a piece of land (totaling 1,000 square meters) containing tile houses, simple sheds, kitchens, etc. in Xigu District for a lease period of 10 years and an annual rent of 19,000 yuan. During the land lease period, the two parties fulfill their respective obligations in accordance with the contract and cooperate well. In October 2020, the lease term expired, and the lessor Chen took the initiative not to renew the lease and leased the land to others, but Wang filed a lawsuit with the Xigu District Court, demanding that Chen compensate him.

Since the contract has been performed, Chen, as the lessor of the land involved in the case, naturally has the right to recover the right to use the land, why does Wang still ask him to give compensation? Originally, the land lease contract previously concluded by the two parties also specifically stipulated that after the termination of the contract, the buildings (including factories, garages, floors, etc.) set up by Wang on the leased site were 50% owned by each party. The plaintiff, Wang, argued that since Mr. Chen had recovered the land involved in the case and the buildings above the ground, he should return to him the value equivalent to half of the building in accordance with the contract. Although the defendant Chen also agreed, he objected to the value of the above-ground buildings, and the two sides argued over this.

In fact, solving this problem is not complicated, just entrust a professionally qualified evaluation agency to assess the price of above-ground buildings. However, the assessment takes a long time, and Wang mou urgently needs money and is unwilling to wait too long.

In order to resolve the contradictions and disputes as soon as possible, the judge actively organized the parties to negotiate and promoted Wang and Chen to reach an agreement on the selection of an assessment body in the shortest possible time. After that, the judge repeatedly docked with the assessment body, followed up and grasped the progress of the assessment in a timely manner, and urged the assessment body to quickly issue the assessment results. The appraisal agency efficiently gave the appraisal opinion and determined that the value of the above-ground buildings totaled more than 190,000 yuan. Based on the land lease contract concluded between the two parties, the judge ordered defendant Chen to compensate the plaintiff Wang according to half of the assessed price, and the judgment has now taken legal effect.
