Open an online store to sell counterfeit baby bottles of well-known brands

In 2022, He Moumou joined an e-commerce company that makes maternal and child products, learned some e-commerce knowledge, and found a home that sells counterfeit Hegen brand baby bottles by chance. In January 2023, he registered a mother and baby store on the shopping platform to sell counterfeit Hegen brand bottles and accessories at a higher price. With the passage of time, He Moumou found a cheaper source of goods, and registered an online store specializing in the Pigeon brand, "purchased" from the previous home, and sold counterfeit Pigeon brand bottles and accessories at a higher price, which were shipped by the previous family and provided after-sales. After opening up the market, He Moumou used his relatives' ID cards to register two mother and baby stores in a row, and opened one with his friends, operating a total of five online stores.
In August 2023, after discovering relevant clues, the public security organs arrested He Moumou. According to the appraisal of the relevant products sold in the store operated by Mr. He, the relevant rights holders are all counterfeit goods with registered trademarks. He Moumou also confessed that he always knew that he was selling counterfeit goods. After review, from January to August 2023, the total amount of counterfeit sales in the store operated by He Moumou was RMB 310,000.

After the case, He Moumou withdrew his illegal gains with the help of his family, and the public security organs followed the relevant clues and found out the counterfeiting gang to realize the whole chain of cracking down on the upstream and downstream of counterfeit sales.
After reviewing the case, the Hongkou District Procuratorate held that He Moumou violated the national trademark management regulations by selling goods that he knew were counterfeit registered trademarks, and his behavior violated Article 214 of the Criminal Law of the People's Republic of China, and he should be investigated for criminal responsibility for the crime of selling goods with counterfeit registered trademarks, so he was prosecuted for the crime of selling goods with counterfeit registered trademarks. After the case was tried by the Hongkou Court, the court sentenced He Moumou to one year and six months in prison and a fine of 60,000 yuan for the crime of selling goods with counterfeit registered trademarks.
