More than a year ago, because the owner publicly defended his rights to Tesla, it caused an uproar and triggered a wave of Tesla car owners across the country to collectively protect their rights.
There is only one reason: the brakes fail!
The hour reporter combed and found that on August 12, 2020, Mr. Chen, the owner of wenzhou, said that at a distance of about 100 meters from the parking lot, his Tesla accelerated out of control, and the brakes did not work, hitting more than a dozen cars before stopping.
Subsequently, Tesla cooperated with law enforcement departments and identification agencies to obtain the driving data recorded on the vehicle's "black box" by retrieving the vehicle's EDR data and decrypting it. Subsequently, Tesla sued the owner of the car for infringing the right to reputation, and the Lucheng District People's Court of Wenzhou City accepted the case on June 9 last year.
In October last year, the Lucheng District People's Court of Wenzhou City issued a civil judgment on the Wenzhou car owner's account on the social platform that the collision accident caused by Tesla's brake failure was not consistent with the owner's statement on the social platform, which constituted an infringement of the plaintiff's (Tesla Shanghai Co., Ltd.) reputation rights, and demanded that the defendant apologize to the plaintiff on the Douyin platform and compensate the plaintiff for 50,000 yuan of losses as appropriate.
The case was tried by the Wenzhou Intermediate People's Court in the second instance, and the judgment took effect in March this year.
According to yesterday's apology statement, Mr. Chen, the owner of The Wenzhou Tesla, said that on the night of the accident, when driving home, he suddenly found someone in front of him and wanted to step on the brakes, but he stepped on the wrong accelerator. He also said that after the accident, although he knew that he had stepped on the accelerator as a brake, he was unwilling to fabricate "Tesla automatic acceleration brake failure" and other content on multiple media.
In the apology letter, Mr. Chen also mentioned that a number of other car owners had asked him to defend his rights together. At the same time, a Shanghai car owner introduced a platform to provide free lawyers for him.
As soon as the apology letter of Mr. Chen, the owner of Wenzhou, came out, it also made one of the "brake doors" that had been hotly discussed temporarily "come out of the water". However, the specific situation of several other car owners, especially the most concerned "roof rights protection" car advocates, has not yet reached a "settlement".
