[Dual citizenship cannot protect "anti-China and chaotic Hong Kong" elements]

The Australian Broadcasting Corporation quoted a spokesman for the Australian Department of Foreign Affairs and Trade as saying that a Hong Kong man holding dual Australian and Chinese citizenship was arrested on January 6, 2021, in violation of Hong Kong's national security law, and was charged by Hong Kong authorities with conspiracy to subvert state power. The spokesman did not name the defendant, but said that the HONG KONG SAR government did not recognize dual nationality and therefore repeatedly refused to meet with the defendant by the staff of the Australian Consulate in Hong Kong.

In response to media enquiries, the Security Bureau of the Government of the Hong Kong Special Administrative Region said that under the Nationality Law of the People's Republic of China, the People's Republic of China does not recognize Chinese citizens as having dual nationality. Unless a Chinese citizen has applied for and been granted permission to withdraw from Chinese nationality, or declares a change of nationality, he or she is still a Chinese citizen. Except for any special bilateral agreements, Chinese citizens are not allowed to obtain foreign consular protection in the HKSAR because they hold foreign travel documents.

Observers have pointed out that the Hong Kong SAR Government's firm implementation of the Chinese nationality law has frustrated the intentions of the "anti-China and chaotic Hong Kong" elements in trying to obtain asylum from foreign governments by means of dual nationality, and has also caused the US and Western countries, especially the "Five Eyes Alliance," to use Hong Kong residents who have naturalized these countries to interfere with and sabotage Hong Kong's conspiracy to practice "one country, two systems."
