On the 17th, the State Administration of Market Regulation, the Ministry of Public Security, and the Ministry of Agriculture and Rural Affairs jointly released ten typical cases of special law enforcement actions for fake and shoddy food in rural areas.

Case

1 Beijing investigated and dealt with the production and sale of counterfeit "Quanjude" roast duck

The label contained false content "Jingyuede" brand Peking Duck case

In April 2021, according to the clues of the Beijing market about the low-priced "Quanjude" roast duck, the Beijing Municipal Bureau of Market Supervision locked Beijing Xinsheng Rongda Trading Co., Ltd. and its legal representative Kong Mou, destroyed the warehouse located in Licun, Fangshan District, and seized nearly 2,000 suspected counterfeit "Quanjude" packaging materials and 4,905 "Jingyuede" brand Beijing roast ducks on the spot.

After investigation, Kong and others purchased counterfeit "Quanjude" packaging materials at a price of 1 yuan per set, purchased plastic roast duck at a price of 13.5 yuan per piece, and shipped to Beijing for distribution to the downline at a price of 20 yuan per piece.

After investigation, the label contained false content, and the entrusted party marked on the outer packaging was a food co., LTD. in Dezhou City, Shandong Province, and was actually a food factory in Boye County, Baoding City, Hebei Province.

In violation of the first paragraph of Article 71 of the Food Safety Law of the People's Republic of China, the Beijing Municipal Bureau of Market Supervision imposed an administrative penalty of confiscating 201,000 yuan of illegal gains, confiscating 4,905 "Jingyuede" brand Peking ducks with illegal production and operation, and 10 times the value of the goods, revoking the food business license, and imposing an administrative penalty on the legal representative Kong Mou for not applying for a food production and operation license within five years, or engaging in food production and operation management. Serve as an administrative penalty for food safety management personnel of food production and trading enterprises.

2 Zhejiang Jinhua investigated and punished Longding Vice Food Trading House in Pujiang County

Production and operation of edible oil marked with false production dates

and the case of engaging in wholesale salt business without authorization

In November 2020, the Market Supervision Bureau of Pujiang County, Jinhua City, Zhejiang Province, based on a report, inspected the Pujiang County Longding Vice Food Commercial Company located in the urban-rural interface.

After investigation, Pujiang County Longding Vice Food Commercial Company holds a food business license, and since May 2020, it has successively purchased 100 sets of edible oil and edible oil packaging of 4 different brands; in August 2020, the parties opened the packaging of a batch of edible oil that was close to the shelf life and loaded it into the above 100 sets of oil barrels, and replaced the packaging as a newly produced date, mixed with the normal edible oil purchased in the same batch, and sold as new oil. As of the occurrence of the case, the edible oil after the replacement of packaging has all been sold out, and the value of the goods is 14950 yuan. Law enforcement officials ordered the parties to recall the changed packaging of edible oil, recalling a total of 148 barrels of problem edible oil, and supervised the destruction on December 30, 2020.

The above-mentioned acts of the parties violated the provisions of Article 34 (10) and 35 of the Food Safety Law of the People's Republic of China, and were illegal acts of producing and operating food without permission and marking the date of production; at the same time, during the inspection, it was found that the parties were non-salt designated wholesale enterprises and engaged in salt wholesale business without authorization, violating the relevant provisions of the Salt Monopoly Measures. The Market Supervision Bureau of Pujiang County, Jinhua City, made an administrative penalty of confiscating illegal gains and fining 502,800 yuan in accordance with law.

3 Chongqing Yubei investigated and punished Mao Shunming Agricultural and Sideline Products Business Department

Illegal use of industrial rosin to process pork head meat

In August 2020, the Market Supervision Office of Muer Town, Chongqing Yubei District Market Supervision Bureau, based on the report, inspected the Agricultural and Sideline Products Business Department of Mao Shunming in Yubei District, and found that the food processing point used industrial rosin for hair removal.

After inspection, the main ingredients of residual rosin used in the washed pork head, rosin used in boiling and unused rosin are all rosin acid (industrial rosin). By the time of the case, the parties had processed about 8,000 pig heads counting 40,000 catties using industrial rosin, with the value of the goods involved in the case exceeding 1.92 million yuan and the illegal gains exceeding 1.44 million yuan.

The conduct of the parties violated Article 34 (1) of the Food Safety Law of the People's Republic of China, constituting an illegal act of adding chemical substances other than food additives to food. At present, the case is still being handled.

4 Tianjin Investigation and Punishment xinhaifu food trading co., LTD

Sale of food that infringes the exclusive right to use a registered trademark

and failure to fulfill legal obligations such as the Food Safety Law

In January 2021, the Tianjin Municipal Market Supervision Comprehensive Law Enforcement Corps inspected the business premises and warehouses of Tianjin Xinhaifu Food Trading Co., Ltd. based on the report, and found 277 boxes of Pepsi Cola concentrated syrup produced by Nanjing Pepsi Cola Beverage Co., Ltd., which was used for sales.

After on-site identification, the above-mentioned syrup products are not produced by Nanjing PepsiCo and are goods that infringe the exclusive right to use the "PepsiCo" trademark. Law enforcement officers seized the above-mentioned goods on the spot and sent samples for inspection. After investigation, the food involved in the case met the food safety standards, but infringed the exclusive right to use the registered trademark, the parties purchased a total of 500 boxes of the above syrup, 223 boxes have been sold, and the supplier's business license, food business license and food qualification certification documents and other materials were not checked at the time of purchase.

The conduct of the parties violated Article 57 of the Trademark Law, the first paragraph of Article 53 of the Food Safety Law and article 67 of the Implementing Regulations of the Food Safety Law, constituting the purchase of food without inspection of the certificate of conformity and the sale of goods infringing the exclusive right to use the registered trademark, and the Tianjin Municipal Market Supervision Comprehensive Law Enforcement Corps issued an administrative penalty of warning the company in accordance with the law, confiscating 265 boxes of Pepsi Cola concentrated syrup that infringed the exclusive right to use the registered trademark, and fining 458,000 yuan. At the same time, the main person in charge of the party, Chen Mou, was directly responsible for the above-mentioned illegal acts, and according to Article 75 of the Regulations for the Implementation of the Food Safety Law, the Tianjin Municipal Market Supervision Comprehensive Law Enforcement Corps imposed an administrative penalty of "a fine of 20,000 yuan" on Chen.

5 Chengdu, Sichuan Province, investigated and punished Lin Mou

Sale of uninspected quarantine hair belly cases

In December 2020, the Chengdu Jinniu District Market Supervision Bureau received a tip from the public security organ that when carrying out a cold chain epidemic food inspection on Jinfurong Avenue in Jinniu District, Lin Mou (the cargo owner) drove a vehicle loaded with about 1 ton of fresh hair belly that may be involved in the epidemic, and the Jinniu District Bureau immediately conducted an on-site investigation.

After investigation, the total of 1070 kilograms of hair belly was purchased by Lin Mou from abroad through WeChat contact, and he did not perform the obligation of inspection of the purchase goods when picking up the goods, and did not obtain the inspection and quarantine import customs clearance certificate, nucleic acid test report, killing certificate and other documents.

The party, Mr. Lin, violated Articles 34 and 53 of the Food Safety Law by operating unspecified hairy belly and failing to perform the obligation of inspection of incoming goods. In accordance with Articles 123 and 126 of the Food Safety Law, the Jinniu District Market Supervision Bureau gave the parties a warning, confiscated the hair belly involved in the case, and imposed an administrative penalty of 2.086 million yuan on 17 times the value of the goods.

6 Hangzhou, Zhejiang Province cracked "3.30"

Manufacture and sale of toxic and harmful cattle blinds series case

In March 2021, according to the clues found in the work, the Hangzhou Municipal Public Security Bureau detected the series of cases of manufacturing and selling toxic and harmful cattle blinds, smashed 7 criminal gangs, arrested 27 criminal suspects, and seized 4 tons of cattle blinds illegally added to formaldehyde and other non-edible substances at the scene, with a case value of more than 2 million yuan.

After investigation, Huang X, Liu X and other criminal gangs used chemical substances such as hanging white blocks and formaldehyde to soak and increase the weight of beef tripe and beef louvers in the courtyard of the hangzhou urban-rural junction and sell them to some local farmers' market stalls. After the case was solved, the local government organized a special rectification of animal offal products sold in the market, and achieved obvious results.

7 Henan Xinxiang cracked "7.21"

The case of manufacturing and selling counterfeit brand mineral water

In October 2021, according to the clues found in the work, the Xinxiang Municipal Public Security Bureau detected a case of manufacturing and selling counterfeit brand mineral water, arrested 12 criminal suspects, and seized 336,000 bottles of finished counterfeit brand mineral water, more than 500,000 bottles, more than 800,000 bottle caps, and more than 600,000 labels.

After investigation, since 2018, criminal suspect Zheng Moumou and others have set up dens in rural houses, purchased equipment, built production lines, pumped underground well water for simple filtration and filled counterfeit brand mineral water, developed the offline through WeChat, and sold the products involved in the case to a number of provinces, with a case value of more than 20 million yuan. At present, the case has been transferred to the procuratorial organs for review and prosecution.

8 Chongqing Yunyang cracked the case of Hu Moumou and others manufacturing and selling fake wine

In January 2021, according to the clues found in the work, the Chongqing Municipal Public Security Bureau Anti-Counterfeiting Corps and the Yunyang County Public Security Bureau detected a case of manufacturing and selling fake liquor, arrested 14 criminal suspects, and seized 2 tons of fake liquor, 15,000 bottles of counterfeit volkswagen brand liquor, and more than 80,000 sets of fake liquor packaging materials.

After investigation, since January 2018, criminal suspect Peng Moumou and others have purchased wine bottles, bulk liquor and packaging materials without the permission of the trademark rights holder, set up dens in rural courtyards in Ya'an City, and mass-produced and sold counterfeit brand liquor, with a case value of more than 10 million yuan. At present, the case has been transferred to the procuratorate for review and prosecution.

9 Xiamen, Fujian Province cracked the "6.11" case of private slaughter and indiscriminate slaughter of live pigs

In June 2021, according to the clues found in the work, the Xiamen Municipal Public Security Bureau detected a case of private slaughter and indiscriminate slaughter of pigs, arrested 38 criminal suspects, seized more than 100 pigs at the scene, and slaughtered 6800 kilograms of white pigs.

After investigation, since January 2021, Meng Moumou's criminal gang has leased a number of simple houses in remote locations in local rural areas, privately set up pig slaughtering points, purchased a large number of uninspected and quarantined pigs from inside and outside the province, and sold them to the market after slaughtering them privately. At present, the case has been transferred to the procuratorate for review and prosecution.

10 Anhui Lu'an investigated and punished Zhang Moumou

Cases of producing and selling food that does not meet safety standards

In October 2020, law enforcement officers from the Agricultural and Rural Bureau of Jin'an District, Lu'an City, Anhui Province, during routine inspections at the African swine fever checkpoint at the entrance of the Chengbei Expressway, found that the JAC light ordinary truck with the license plate of Anhui AWU973 was loaded with pig carcasses, a total of 73 heads, each weighing about 23 kilograms.

After on-site inspection, the pig carcass did not have an animal quarantine inspection seal, and the driver could not provide the animal quarantine certificate and the African swine fever test report, and then tested by the Jin'an District Animal Disease Prevention and Control Center, and the batch of pig products was unqualified pig products. After investigation, the batch of pig products is owned by so-and-so claimed to be the goods. The case was then transferred to the Jin'an District Public Security Bureau for investigation in accordance with law.

In March 2021, the Lu'an Intermediate People's Court sentenced Zhang and eight others to the crime of producing and selling food that did not meet safety standards in accordance with the law, and sentenced them to fixed-term imprisonment of six months to one year and eight months, and fined them 10,000 yuan to 70,000 yuan.
