Key trademarks refer to registered trademarks that enjoy high popularity in Shanghai, have greater market influence, are prone to infringement and counterfeiting, and really need to strengthen protection. On May 21, 2020, the Shanghai Municipal Intellectual Property Office revised and formed a new normative document "Measures for the Administration of the Shanghai Key Trademark Protection Directory", and in accordance with relevant regulations, timely published the protection list through the official website, news media, etc., and announced to the public the inclusion, removal and adjustment of key trademarks in the protection directory.

Up to now, the city has issued a total of ten batches of key trademark protection directories, and a total of 782 key trademarks have been included in the list, covering a number of long-established trademarks, famous trademarks, well-known trademarks and high-profile trademarks of foreign-related enterprises in the city.

Among them, the newly released tenth batch of key trademark directories involves 48 registered trademarks of 37 enterprises, involving domestic and foreign enterprises. It includes 35 registered trademarks of 30 domestic enterprises and 13 registered trademarks of 7 overseas enterprises. It covers 21 categories of 45 categories of trademark registration classification, involving clothing, food, housing, travel and other aspects, covering clothing, shoes and hats, convenience food, beer and beverages, catering and accommodation, baby products, daily necessities, medicine, advertising and sales, financial property management, website services, scientific instruments, education and entertainment, means of transport, machinery and equipment and other categories of registered trademarks.

In the tenth batch of key trademark directories, many well-known enterprises are involved. For example, Tesla Company, Chinese, English, graphics and other four registered trademarks included in the directory, the company as a multinational enterprise in the field of electric vehicles, has a high reputation. Published by Shanghai Children's Publishing House Co., Ltd., "100,000 Whys" is a tutoring book widely known and loved by children and teenagers, which is not only protected by copyright, but also successfully registered "100,000 Whys" on the trademark, and this time it was also included in the list.

After being included in the list of key trademark protection, it will be faster and more accurate in the protection of intellectual property rights. If the trademark right holder is preemptively registered by others to protect the trademark in the list, he may request help from the municipal intellectual property department, which shall give legal guidance and seek the support of the State Intellectual Property Office in a timely manner. It is also necessary to give play to the role of cross-regional cooperation mechanisms for the administrative protection of intellectual property rights, take the initiative to carry out cross-regional and cross-provincial and municipal cooperation in the enforcement and protection of trademark infringement, and improve the protection efficiency of trademarks included in the protection list. At the same time, strengthen coordination with public security, procuratorates, courts, customs and other departments, establish a key trademark protection coordination mechanism, share clues to infringement, strengthen joint crackdowns, and jointly do a good job in protecting trademarks in the protection list.

Where overseas rights protection is involved, the Municipal Intellectual Property Department provides expert consulting, legal policy interpretation, information collection and release and other services for the international registration and protection of trademarks in the protection list, and requests the State Intellectual Property Office to support the overseas protection of trademarks as appropriate.
