The State Administration for Market Regulation recently issued Order No. 43, promulgating the Provisions on the Responsibility for Repair, Replacement and Return of Household Automobile Products (hereinafter referred to as the Provisions on the Three Guarantees of Automobiles), which will come into force on January 1, 2022. On the basis of the "Provisions on the Liability for Repair, Replacement and Return of Household Automobile Products" implemented in 2013, the regulations have been substantially revised, mainly including the following three aspects:

The first is to further increase the protection of the legitimate rights and interests of consumers, and put forward stricter three-guarantee liability requirements for operators.
For example, if a family car needs to replace the engine, transmission, power battery, driving drive motor or its main parts and components due to quality problems within 7 days from the date of the validity period of the three guarantees, the seller shall replace or return the car free of charge according to the choice of the consumer;
It is clarified that when the seller returns or replaces the car for the consumer, it shall compensate the consumer for the loss of vehicle registration fee, decoration fee, related service fee, etc.;
Further reduce the use compensation fee paid by consumers to sellers when returning and replacing the car by reducing the use compensation coefficient;
Producers are required to indicate on the three-pack voucher the attenuation limit of the power battery capacity of household pure electric and plug-in hybrid vehicles for consumers to refer to when purchasing vehicles;
Reduce the restrictions on the cumulative repair of the same quality problem more than 5 times or the cumulative repair time of the whole vehicle exceeding 35 days during the validity period of the three guarantees to 4 times and 30 days;
Stipulate that producers, sellers, repairers and other operators shall not restrict consumers from independently choosing enterprises to carry out maintenance and maintenance of household automobile products, and use them as a reason for refusing to bear the responsibility of the three guarantees;
If the repairer is able to verify the purchase information when performing the responsibility of the three guarantees, the consumer shall be exempted from the obligation to provide the three guarantees of vouchers;
Where consumers lose three packages of vouchers, the seller shall promptly and freely replace them for consumers.
The second is to meet the needs of industrial development and consumption upgrading, and expand the scope of adjustment of the three guarantees for household cars.
In view of the rapid development of household electric vehicles, the quality of special components such as power batteries and driving drive motors is included in the three-pack return and replacement clause;
Implement three packages for household pickup trucks, protect the rights and interests of pickup truck consumers, and promote the rapid development of the pickup truck industry;
The main components of household automobile pollution control devices will be included in the provisions for returning and replacing vehicles with major quality problems, and the prevention and control of vehicle emission pollution will be strengthened.
The third is to further improve the relevant regulatory system in view of the development and changes of the three guarantees of household cars.
Strengthen the quality responsibility of producers, requiring producers not to deliberately delay or refuse assistance and recovery from sellers and repairers without legitimate reasons;
Increase the severity of penalties for illegal conduct, and explicitly impose penalties in accordance with the relevant provisions of Article 56 of the Law of the People's Republic of China on the Protection of Consumer Rights and Interests for business operators who deliberately delay or refuse to bear the responsibility of the Three Guarantees without a legitimate reason;
Drawing on international practices, relevant organizations are encouraged to establish a three-guarantee liability dispute handling mechanism for household cars, so as to facilitate the use of third-party professional resources to provide consumers with fair, professional, convenient and efficient three-guarantee dispute handling services free of charge, while reducing administrative and judicial costs.
