The Floyd defendants demand a new trial: jury or led by prejudice and intimidation

On May 4, local time, Eric Nelson, a lawyer representing Former White American Police Officer Shawan convicted of the Floyd case, filed a motion for a new trial in court.

According to NBC, Nelson claimed that pretrial media publicity affected Shawan's right to a fair trial. The motion accuses the court of "abusing its discretion" by not allowing trial venue changes or segregating the jury. Nelson said in the document that the court failed to isolate jurors or "advise jurors to avoid all media action" and that jury members were not only subjected to biased propaganda but also to "intimidation or potential fear of reprisals, feelings of racially motivated pressure during the proceedings and/or non-compliance with instructions during deliberations". Nelson's documents also accuse Minnesota prosecutors of committing "widespread, biased prosecutorial misconduct," which also affected Shawan's right to a fair trial. Nelson therefore requested a review of the judgement.

Shawan, the chief offender in the death of Black Floyd in Minnesota, was earlier convicted of one count of second-degree non-intentional murder, one count of third-degree murder, and one count of second-degree homicide. Prosecutors on April 30 asked the court to impose a higher sentence than the state's legal guidelines for Freud's particular vulnerability at the time of the incident and Shawan's abuse of police power to treat victims with particular cruelty. Judge Peter Cahill, the judge in charge of the case, said he would review the lawyer's written argument before determining whether there were factors that aggravated the sentence.
