Not long ago, the People's Procuratorate of Dongyang City, Zhejiang Province, handled the case of the production and sale of fake beef supervised by the Ministry of Public Security, and the criminal suspect Wang Moudeng and 26 other people passed off chicken and duck meat and pork as beef jerky and sauce beef after secondary packaging, and opened more than 70 online stores on an online platform to sell, with sales of more than 60 million yuan.
Recently, the criminal gang was prosecuted by the Dongyang Municipal People's Procuratorate in accordance with the law on suspicion of producing and selling fake and shoddy products.
Secondary packaging in rental housing
In September 2020, Wang Moudeng from Shangqiu City, Henan Province, saw that it was profitable to sell counterfeit beef jerky at a low price, so he looked for a source of goods to buy chicken jerky and "shredded beef jerky" packaging bags, and teamed up with a number of fellow villagers to recruit people to package chicken jerky into the outer packaging of beef jerky in Yucheng, Henan, Dongyang, Zhejiang and other places, and sell it on online platforms as beef jerky. The chicken jerky is divided into bags ranging from 160 grams to 200 grams per bag, plus desiccant, and packed into yellow kraft paper packaging bags with the words "pulled beef jerky" written on them, and each bag costs about 9 yuan on the online platform.
In January and August 2021, Wang Moudeng's packaging dens were successively investigated and dealt with by the market supervision departments of Yiwu City and Dongyang City, but Wang Moudeng still did not stop, and instead rented a house in a village in Baiyun Street, Dongyang City, packaging and selling fake sauce beef.
The landlord, Hu Moudong, introduced that he rented his basement to Wang Moudeng to engage in food packaging, but after a long time, he found that the basement often emitted the smell of meat spoilage. He also found that the trucks were carrying boxes with the words "Sauce Pork" written on them, but the workers packed the plasticized meat into the outer packaging bags with the words "Sauce Beef" written on it, and then packed it for shipment.
"I realized that they were definitely not in accordance with the law, but I thought that the basement would be rented out to make more money, so I didn't care, and sometimes I helped them avoid inspection." Hu Moudong said.
"Express scalpers" earn the difference
In order to broaden sales channels, Wang Moudeng's gang also used their own and relatives and friends' ID cards and bank cards to open more than 70 online stores on an online platform, and Wang Moudeng provided the source of goods, and the actual operators of the online store received orders and operated on the platform, and printed express delivery bills and packaged sales in Dongyang, and the profits were divided between the online store operator and Wang Moudeng.
"'Oxtail' don't have a whole hair, it is easy to be seen as a chicken neck ......" "There is an accident in Fujian warehouse, beef jerky will be removed from the shelves first......" The criminal gang has set up a social group to exchange how to deal with customer complaints, deal with professional anti-counterfeiters, etc., and withdraw cash and share the stolen goods in the online store.
The "best-selling" of fake beef has brought huge express parcel throughput, from which the crime of "express scalping" has been breeded.
"Negotiate with the express company at a price lower than the market price, and then negotiate the price with the customer to earn the difference in the middle." The criminal suspect Wang Moudong has been engaged in express delivery and reception for a long time, and Wang Moudeng was introduced to Wang Moudong when he was operating a packaging den in Yiwu, so he has been handing over the express delivery and receipt of fake beef to Wang Moudong to be responsible.
With the deepening of "cooperation", Wang Moudong knew that it was a crime for Wang Moudeng and others to make and sell fake beef with fake and real, but in the face of the huge temptation of interests, he still chose to continue to help the criminal gang, charging more than 2 million yuan in courier fees.
Set up a company to produce and sell itself
In order to further reduce costs and increase profits, in July 2022, Wang Moudeng proposed to establish a food limited company to develop its own sauce pork for the supply of online stores. Decoration, recruitment, equipment, raw materials, formula...... The nine "shareholders" of the criminal gang have a clear division of labor. Soon, the food company was up and running somewhere in Henan.
"After the establishment of the company, it was mainly to make braised pork." According to the confession of the workers of the food company, the production of braised pork has to go through a series of processes such as thawing, pickling, marinating, cooling, segmentation, packaging, etc., and more than 20 additives such as beef paste, pork paste, color protector, thickener, carrageenan and so on need to be added in the processing process, and the frozen pork is finally processed into pork with beef flavor.
After the beef-flavored pork is produced, workers use aluminum foil bags for vacuum packaging, each small bag of braised pork weighs about 200 grams, and every 100 small packets are packed into a large woven bag, but there is no logo on the small package, and there is no information such as production date and raw materials. Subsequently, the sauce pork will be transported to the secondary packaging dens for "makeover" to become "sauce beef" and sold on online platforms.
After investigation, from November 2022 to January 2023, the food company produced and sold a total of more than 6 million yuan worth of beef-flavored pork and duck in sauce.
The criminal gang was caught
In June 2023, Wang Moudeng's criminal gang was arrested one after another.
After investigation, the criminal suspect Wang Moudeng, together with Wang Mouzhen and others, opened an online store to sell fake beef jerky and fake sauce beef, with a sales amount of more than 60 million yuan, and Wang Moudeng made illegal profits of at least 1.38 million yuan.
The procuratorate believes that criminal suspect Wang Moudeng and others violated Article 140 of the Criminal Law by passing off fake as real in the process of producing and selling products, and the facts of the crime are clear, the evidence is credible and sufficient, and they should be investigated for criminal responsibility for the crime of producing and selling fake and shoddy products.
"Knowing that others have committed crimes and providing assistance are also punished." The prosecutor in charge said that the landlord Hu Moudong's act of providing facilitation conditions knowing that others were committing the crime of producing and selling fake and shoddy products also constituted a crime.
