Criminal liability will be pursued if the circumstances are serious.

Reselling tobacco is a crime of illegal business operation. Whoever disrupts market order and, if the circumstances are serious, shall be sentenced to fixed imprisonment of not more than five years or criminal detention, and shall also be fined, or shall alone, be fined not less than one time but not more than five times the unlawful gains. If the circumstances are particularly serious, he shall be sentenced to fixed-term imprisonment of not less than five years, and shall also be fined not less than one time but not more than five times the unlawful gains or confiscation of property.

"The circumstances here are particularly serious": refers to (1) the amount of illegal business operations is more than 250,000 yuan, or the amount of illegal income is more than 100,000 yuan; (2) Illegally dealing in more than one million cigarettes.
