The compensation for killing is provided for in article 232 of the Criminal Code. On June 5, 2021, a homicide case occurred in Anqing, Anhui Province, in retaliation for society. At 16:23 p.m., Wu Liang appeared on the local pedestrian street with a knife, and he stabbed 20 passers-by who did not know him, which eventually led to the serious consequences of 13 people being injured and 7 dead.
There are many reasons for intentional homicide, and it is terrible to kill innocent people indiscriminately in order to vent their anger and then be unreasonable. Imagine if we were a passerby, when you were leisurely shopping, a person suddenly came out next to you and directly asked for your life, who can understand?
I have no vendetta against you, so why are you doing this? Many people are frustrated by family feelings or career progress, and then go to extremes. Wu Liang is such a person, and his dissatisfaction with his family has further evolved into social dissatisfaction.
Judging from the reasons for the killing, Wu Liang's plot is bad, because the reason for retaliating against society is anti-social; from the perspective of the target of the killing, these passers-by have no revenge and no revenge against Wu Liang, and Wu Liang is despicable; judging from the number of people killed, 7 people died, and Wu Liang only had 1 life.
Therefore, on November 15, 2021, the Anqing Intermediate People's Court sentenced Wu Liang to death. What people can't understand is that Wu Liang did not appeal, which shows that Wu Liang already has the determination to die, which can be seen that he is still self-aware.
In fact, in a case like his, the purpose of the appeal is nothing more than to live a few more days, because no matter which judge knows that he will be sentenced to death and executed immediately.
For example, on May 22, 2021, Liu Dong of Dalian, Liaoning Province, took revenge on society for his own setbacks, drove a BMW car to speed up and crashed, resulting in 5 deaths and 5 injuries, which undoubtedly he should also be sentenced to death, but he appealed after being sentenced to death in the first instance.
The Code of Criminal Procedure stipulates that the right of appeal is the most important right of the accused and may not be taken away by anyone. The results of the second instance were obvious after February 9, 2022, when the Liaoning Provincial High Court rejected his appeal.
Comparing the two cases, it is obvious that Liu Dong was 14 days earlier than Wu Liang, but Wu Liang was executed on February 15, 2022, and Liu Dong's case is still under death penalty review.
Liu Dong was sentenced to death, why did he live for a few more months after appealing?
In order to show respect for life, the law sets up special procedures to guarantee the right of criminal suspects to defend. For example, for those who may be sentenced to life imprisonment or the death penalty, the Code of Criminal Procedure stipulates that a defense lawyer must be present to defend them.
If Liu Dong did not hire a defense lawyer during the second trial, the case-handling organ must appoint a lawyer to provide a defense for Liu Dong. Although defense lawyers provide defenses in accordance with the law, the death penalty applies to criminals who have committed extremely bad crimes, and the so-called "bad" is a value judgment that is always a space for debate.
In addition, in cases where the death penalty is imposed in the first instance, a hearing must be held after entering the second instance. Since the trial is held, the procurator must appear in court to express his opinion, which means that the procurator must be shown the file for 1 month, and the trial time of the second-instance court is generally 2 months. This delay will probably take at least 3 months.
