Recently, the Ministry of Public Security of the People's Republic of China issued a document disclosing that the "Measures for the Administration of Scoring of Road Traffic Safety Violations" has been adopted (hereinafter referred to as the "Scoring Management Measures"), and the new Scoring Management Measures will be implemented from April 1, 2022.
According to the new scoring management measures, in a natural scoring cycle, motor vehicle drivers can participate in full-score study and examination in accordance with the provisions of these Measures before the score reaches full score, so as to achieve partial demerit points. Conversely, when a motor vehicle driver deducts 12 points in a natural scoring cycle, he or she cannot deduct points for full score study and examination.
At the same time, compared with the old version of the scoring management measures, the new points management measures will cancel the 2-point value, and relax the treatment of some illegal acts, and also delete/add several provisions. The score of the new scoring method will be based on the severity of the traffic offence, and the score of a single demerit will be fixed into 5 grades, including 12, 9, 6, 3 and 1.
In a 12-point traffic violation, when the new scoring management measures are relaxed for some illegal acts, we can see that 4 violations will be reduced from 12 points to 9 points/6/3 points:
1. This includes a reduction of 9 points for offences involving the driving of a motor vehicle that does not conform to the type of quasi-driving vehicle;
2. Driving a motor vehicle that does not hang the number plate of a motor vehicle or deliberately obscures or defaces the number plate of the motor vehicle on the road is reduced to 9 points;
3. Escape after a traffic accident that causes minor injuries or property damage, and the illegal act that does not constitute a crime is reduced to 6 points;
4. The illegal act of driving on the road without installing a motor vehicle number plate in accordance with the regulations is reduced to 3 points.
In addition, the subdivision also added a deduction clause, and the remaining 6 illegal acts remained more than 12 points in the deduction score, and the relevant clauses remained basically unchanged. (As shown in the figure below)
In addition to the above mentioned two violations that have been reduced from 12 points to 9 points, only a one-time 9 point violation has been added - driving a motor vehicle on a highway or urban expressway illegal parking.
Among the five scoring levels, the change in the illegal clause of 6 points at a time is the smallest.
After the act of driving a motor vehicle without giving way to school buses in accordance with the regulations was reduced to 3 points, the new scoring management measures only added two illegal acts of driving a passenger car with more than 7 seats carrying more than 20% of the approved number of people and not reaching 50%, or driving other passenger cars to carry more than 50% of the approved number of people and not reaching 100%.
After the abolition of the 2-point system in the new scoring management measures, the provisions originally included were upgraded or demoted to scores, of which the clauses upgraded from a one-time 2 points to 3 points included driving a motor vehicle that overtook or occupied the opposite lane or interspersed with waiting vehicles when driving a motor vehicle in front of them stopped in line or drove slowly; driving a motor vehicle had behaviors that hindered safe driving, such as making and answering handheld phones.
In the illegal clause of 3 points at one time, the driving of a motor vehicle in violation of the prohibition sign, the prohibition marking instruction, and the driving of a highway passenger car, tourist passenger car, and dangerous goods transport vehicle other than a highway passenger car, tourist passenger car, and dangerous goods transport vehicle that does not carry out regular safety technical inspections in accordance with the regulations are reduced from 3 points to 1 point.
At the same time, 2 more violations were added to the 3-point sub-level. (As shown in "one" and "four" in the following figures)
In addition, driving a motorcycle without wearing a safety helmet and the failure of a motor vehicle driver to wear a seat belt as required when driving a motor vehicle are reduced from a one-time deduction of 2 points to 1 point.
However, if you do not reverse or make a U-turn on the road other than the highway and the urban expressway, you also need to be punished with 1 point in the new scoring management measures.
It is worth emphasizing that the new scoring management measures do not mention that when a motor vehicle driver drives a motor vehicle on an ordinary road or highway, less than 20% of the prescribed speed needs to be punished for scoring.
In other words, if you are driving on a highway with a speed limit of 120km/h, as long as your maximum speed does not exceed 144km/h, then your speeding behavior in the 120-144km/h range will not be included in the "illegal act".
It is evident that the new scoring management method has raised the scoring threshold for speeding behavior to a large extent. Moreover, the new scoring management measures also completely delete 5 scoring clauses, such as the motor vehicle did not place inspection pass marks, insurance marks, and did not carry the driving license and motor vehicle driving license with the vehicle.
Of course, although the new scoring management measures relax the scoring threshold for illegal acts, the new scoring management measures also punish "turtle speed" models. For example, driving a motor vehicle on a highway below the prescribed minimum speed will be punished with a one-time penalty of 3 points.
