In the end, a 3-year-old lost his mother forever, and the reckless husband was sentenced to life imprisonment by the Jinan Intermediate Court for intentional homicide.

According to the relevant judgment, the Jinan Municipal People's Procuratorate alleged that one day in December 2019, defendant Wang Xin (pseudonym) strangled the neck of the victim Liu Yue (pseudonym) with his child's pants (i.e., diaper) in his own home in a village in Jiyang, causing him to suffocate and die.

After the court trial, it was found that Wang Xin and his wife Liu Yue (aged 38) married in 2016 and had a son. Because Liu Yue usually ignores housework, the two often quarrel. On the day of the crime, Wang Xin once again quarreled with his wife over family trivia, and Wang Xin became angry and embarrassed, strangled Liu Yue's neck with the child's diaper, causing him to suffocate to death, and then hid the diaper under the TV cabinet.

During Wang Xin's surrender at the police station, Wang Xin's brother, in order to alleviate his brother's crime, threw the diaper that Wang Xin used to commit the crime under the TV cabinet and sank it into a nearby river to help him destroy the evidence.

What happened when the crime occurred?

After Wang Xin returned home, he was pushed down by Liu Yue in the courtyard, and Wang Xin picked up a pair of pants hanging outside and strangled Liu Yue's neck, but he was afraid that something would happen and then let go. Wang Xin's brother identified to the police that a location near Wang Xin's home by the river was where he tied the diaper used for Wang Xin's crime to a brick and discarded it, and the police salvaged the tool in the river.

The Jinan Intermediate People's Court held that the defendant Wang Xin deliberately and illegally deprived others of their lives, causing the death of one person, and Wang Xin's conduct constituted the crime of intentional homicide in accordance with law; Wang Xin's brother helped destroy evidence, the circumstances were serious, and his conduct constituted the crime of helping to destroy evidence according to law.

Wang Xin could not correctly handle the marital conflict with his wife, only because Liu Yue usually ignored the housework, and at the time of the crime, he supported him to cook and did not let him sleep, and he had evil intentions of killing, the consequences of the crime were serious and should be punished, in view of the fact that this case was caused by the intensification of family conflicts, the victim Liu Yue had a certain responsibility for the cause of the case, and the defendant Wang Xin could be given a lighter punishment as appropriate. After Wang Xin's case occurred, he surrendered himself, admitted guilt and accepted punishment, and gave him a lenient punishment in accordance with law.

The defender's opinion that the victim has serious fault cannot be established and is not adopted, and the opinion that Wang Xin voluntarily surrendered and admitted guilt and accepted punishment, and the opinion requesting that he be given a lighter punishment is established and adopted.

Recently, the Jinan Intermediate People's Court ruled that Wang Xin committed intentional homicide and sentenced him to life imprisonment and deprivation of political rights for life. Wang Xin's brother was convicted of helping to destroy evidence and sentenced to one year in prison, suspended for one year.
