On April 23, the Haidian People's Court held a press conference to report on the adjudication of intellectual property cases in the digital economy in the past three years, and released a white paper on intellectual property adjudication and ten typical cases.

According to the press conference, in the past three years, Haidian courts have accepted a total of 4,851 intellectual property cases involving the digital economy, accounting for 56.7% of all intellectual property cases, concluded 4,840 intellectual property cases in the digital economy, and concluded 1,447 cases by judgment, with a maximum compensation of more than 2,100 yuan. "Focusing on the construction of the core area and the 'two zones' of the Beijing International Science and Technology Innovation Center, in 2023, the Haidian Court will make simultaneous efforts in the management of litigation sources, platform construction, and professional trials, so as to provide precise services for the innovative development strategy and the healthy development of the digital economy. "Judging from the digital economy-related cases heard by the Haidian court, the protection of data rights and interests on the platform has increasingly become a hot spot and focus of similar cases, the protection of digital cultural products has attracted much attention, and the infringement methods in online platforms are also constantly changing. At the press conference, Yang Dejia, President of the Fifth Civil Trial Division (Intellectual Property Division) of Haidian Court, introduced the trial of intellectual property cases involving the digital economy in the past three years, and explained in detail the characteristics and key points of review of such cases. In his view, such cases show new trends such as the protection of data rights and interests on platforms has become a hot topic, the protection of digital cultural products has attracted much attention, and the ways of infringement in online platforms are constantly changing.

Subsequently, judges Wang Qiluan, Li Lisha, Yin Fei, Chen Yue and Li Sidi of the Fifth Civil Trial Division (Intellectual Property Division) released typical cases of intellectual property disputes involving the digital economy. The case provides a professional judicial response to key issues such as the determination of the liability of relevant platforms in the context of the digital economy and the application of punitive damages in disputes over infringement of business secrets, and provides useful guidance for practitioners and participants in the digital economy.
