2. Strengthen top-level design and implement the project to improve customs protection capacity

The national customs will implement the relevant requirements for the construction of an intellectual property power and the "14th Five-Year Plan" customs development plan, clarify the key points, make overall plans and implement precise policies, and accelerate the implementation of the project to improve the customs protection capacity of intellectual property rights.

(1) Continuously consolidate the foundation for the standardization of law enforcement. The General Administration of Customs (GAC) promulgated the Discretionary Criteria for Administrative Penalties of the Customs of the People's Republic of China (III), which will come into effect at the National Customs on 1 January 2024, further unifying and strictly regulating the rules, levels and ranges of administrative penalties for customs protection of intellectual property rights. The national customs law enforcement system for the protection of intellectual property rights has been further improved, and the case handling process has been sorted out and optimized. The customs offices of Fuzhou and Gongbei have formulated and revised the working procedures for the protection of intellectual property rights in the customs areas, the customs of Nanjing and Jinan have compiled and issued operational guidelines, and the customs of Changchun, Shanghai, Ningbo, Fuzhou and Urumqi have carried out inspections of law enforcement work and the review of case files in the customs areas. Customs across the country continues to improve the two-level case-handling mechanism of "directly under the customs + under the customs", and continuously improves the level of law enforcement standardization and the overall work efficiency.

(2) Solidly carry out theoretical research and institutional innovation. Carry out comparative research on the legal systems of customs protection of intellectual property rights in the countries and major trading countries and regions of the Belt and Road Initiative, and complete the compilation and publication of books such as "EU Volume", "American Volume", "Japanese Volume", "Russian Volume" and "Singapore Volume". Explore the innovation of the customs supervision mode of intellectual property protection in the Hainan Free Trade Port, clarify the boundaries and priorities of the responsibilities of the customs in the "first line", "second line" and "island", and form a research report. Actively align with international high-standard economic and trade rules, and conduct research on the protection of intellectual property rights of transit goods with Shanghai Customs as a pilot.

(3) Continue to implement precise policies to improve the effectiveness of law enforcement. For the seventh consecutive year, the national customs deployed the "Longteng Action" to comprehensively strengthen the customs protection of intellectual property rights, and for the fourth consecutive year, the "Blue Net Action" for the protection of intellectual property rights in delivery channels and the "Clean Network Action" for the protection of intellectual property rights of export and transshipment goods. The General Administration of Customs, together with the State Administration for Market Regulation and other departments, jointly issued a notice to launch the 2023 Special Action on Promoting Development and Ensuring Security in Online Market Regulation. In view of the challenges brought to the protection of intellectual property rights by the customs due to the characteristics of cross-border e-commerce products, such as miscellaneous categories, large batches and wide supply channels, the General Administration of Customs issued a work notice to deepen multi-party cooperation, promote enterprise self-discipline, and promote the standardized, healthy and sustainable development of cross-border e-commerce formats.

3. Adhere to special governance and crack down on import and export infringement and illegal acts

With the special action on the protection of intellectual property rights as the main starting point, the national customs has focused on key areas, key links, key channels and high-risk commodities, and has achieved remarkable results in all-round crackdown on import and export infringement and illegal acts.

(1) Pay close attention to the special governance of key areas and key links. In 2023, the national customs will continue to carry out the "Dragon Action" for intellectual property protection to crack down on import and export infringement and illegal activities. Shanghai, Ningbo, Xiamen, Shenzhen, Huangpu and other customs have severely cracked down on "import" and "close-fitting" infringing goods, and seized 17 batches of infringing goods such as food, diapers, cosmetics and other infringing goods, with 5.767 million pieces. Customs in Beijing, Tianjin, Hohhot, Dalian, Ningbo and other countries have strengthened the supervision of safety-related commodities and seized 67 batches and 412,000 pieces of infringing goods such as infringing machinery and equipment, auto parts and bearings, while customs in Chongqing and Xi'an have paid close attention to the protection of intellectual property rights of China-Europe freight trains, and seized 9 batches and 38,000 pieces of infringing goods, promoting the healthy and orderly development of China-Europe freight trains. Guangzhou Customs seized 25,000 pieces of infringing goods such as mobile phones and clothing that infringed on independent intellectual property rights, and Nanjing Customs seized 590,000 toothbrush packaging materials that infringed on the intellectual property rights of foreign-funded enterprises at one time, and handed them over to the public security organs for processing.

(2) Continue to make efforts to control high-risk commodities in delivery channels. In view of the high incidence of inbound and outbound infringements and illegal acts of "breaking the whole into zero" and "ant moving" in the mail channel, the national customs has launched the "Blue Net Action 2023" to comprehensively improve the efficiency of comprehensive governance by strengthening the promotion of mail and delivery enterprises, standardizing declaration management, strengthening risk analysis and information sharing, and increasing resource investment and law enforcement. During the operation, customs across the country detained a total of 58,400 batches and 7,038,800 pieces of suspected infringing goods in the delivery channel. Beijing Customs paid close attention to the emerging high-frequency sending places in a timely manner, and seized 2,100 batches and 2,467 pieces of infringing goods in transit for export by strengthening supervision over international mail general contracting; Shanghai Customs strengthened special guidance on investigation, control and case handling, and seized 7,498 batches and 25,000 pieces of infringing goods through postal and express mail channels; Jiangmen Customs strengthened risk analysis and seized 1,317 pieces of infringing goods in the mail channel at one time.

(3) Three-dimensional crackdown on infringement of export and transshipment goods. In order to effectively crack down on the illegal acts of infringing goods in export transshipment and form a regional linkage protection network, the General Administration of Customs organized the Guangdong Branch and some customs directly under the General Administration of Customs to carry out the "Clean Network Action 2023" for the protection of intellectual property rights of export and transshipment goods, and to crack down on infringing goods exported to or transshipped through Hong Kong and Macao in a three-dimensional manner from sea, air and land transportation channels. The Guangdong Branch Office organized the provincial customs and the Hong Kong and Macao customs to carry out three joint law enforcement actions on intellectual property protection, which achieved positive results. Shenzhen and Huangpu Customs seized 2,268 batches and 8,101,000 pieces of infringing goods such as electronic products, clothing, and bags exported to or transshipped through Hong Kong, while Gongbei Customs seized 121 batches and 41,000 pieces of infringing goods destined for or transshipped through Macao.

(4) In-depth focus on the protection and enforcement of intellectual property rights in new business formats. In order to promote the healthy and orderly development of cross-border e-commerce, the General Administration of Customs conducted research on the theme of "Strengthening the Protection of Intellectual Property Rights in New Fields and New Business Forms", and issued the Notice on Strengthening Customs Protection of Intellectual Property Rights in the Field of Cross-border E-commerce. Guangzhou Customs strengthened the risk research and judgment of cross-border e-commerce channel integration, and seized 1,402 batches and 1.128 million pieces of infringing goods. Qingdao Customs launched a special crackdown on goods through cross-border e-commerce channels, seizing 782 batches and 1,459 pieces of infringing goods. At the same time, Hangzhou, Ningbo and other customs have strengthened the supervision of infringing goods imported and exported through market procurement and other trade methods, and woven a "safety net" for the protection of intellectual property rights.

Fourth, based on intelligent protection and innovation, steadily promote the construction of smart intellectual property rights

In accordance with the requirements of the Overall Plan for the Construction of Smart Customs, the national customs has carried out the construction of smart customs intellectual property scenario projects, and promoted the digital transformation and intelligent upgrading of intellectual property customs protection.

(1) Set up a business team to draw a blueprint for smart construction. The General Administration of Customs organized business backbones to set up a special working class, combined with special research and other activities on the interconnection of information systems, sorted out the difficulties and blockages in the whole chain of intellectual property customs protection "filing, investigation, confirmation, identification, and disposal", and formulated the "Smart Intellectual Property Scenario Application Plan" in accordance with the overall requirements of smart customs construction, formulated construction tasks, and drew a blueprint for building a new work pattern of "smart interaction, smart law enforcement, smart service, and smart collaboration".

(2) Scientifically plan the path and promote the construction of the project as a whole. The General Administration of Customs (GAC) has coordinated and promoted the transformation of the "Smart Intellectual Property Scenario Application Plan" from design drawings to construction drawings, and scientifically planned the overall promotion of smart intellectual property projects. Improve the intelligent screening model of infringement risks, optimize the interconnection and interconnection of the customs protection and enforcement subsystem of intellectual property rights, upgrade the case handling function of the customs protection and law enforcement subsystem of intellectual property rights, build a knowledge base for customs protection of intellectual property rights, and promote a number of projects such as "cloud right confirmation", "pre-confirmation of rights", "development of business operation monitoring platform (intellectual property interface)", "intelligent identification of trademarks and docking with 5G intelligent individual soldier system of non-trade channels" in some customs on a pilot basis.

(3) Based on key areas, early harvest and outstanding results. The General Administration of Customs (GAC) has successfully imported the intellectual property filing data into the customs big data lake, laying the foundation for the realization of data interconnection and interoperability in the whole process. The trademark intelligent identification application developed by the General Administration of Customs has been used in the national customs, which integrates intellectual property data resources into the individual inspection equipment, and intelligently realizes "second query and second feedback" through "map searching" and background network comparison, with a retrieval accuracy rate of 95% Above, Shanghai Customs has carried out more than 250 batches of infringement investigations through the application, seized a number of cases such as infringing jersey suits, and Wuhan Customs seized the first intellectual property case after the temporary opening of Ezhou Huahu Airport through the application, and the application effect has been fully confirmed in the front-line law enforcement links. Beijing and Shenzhen Customs have enabled right holders to confirm the intellectual property status of suspected infringing goods online through the form of "cloud right confirmation", reducing the time for compliance verification of intellectual property rights of goods by up to 95%.

5. Deepen coordination and co-governance, and weave a dense network for the protection of the entire chain of intellectual property rights

The national customs has earnestly implemented the requirements of the strategic deployment of building a strong country with intellectual property rights, continuously improved the ability of inter-customs cooperation, strengthened the joint force of customs and local co-governance, optimized exchanges and cooperation between customs and enterprises, and systematically promoted the construction of a full-chain protection mechanism for intellectual property rights.

(1) The linkage of law enforcement between customs areas is more efficient and connected. In 2023, 371 law enforcement collaborations were carried out within the national customs system, further enhancing the facilitation of intellectual property protection. The Beijing-Tianjin-Hebei region, the Yangtze River Delta, the Western New Land-Sea Corridor and other regional customs have basically formed a mechanism for sharing infringement clues, discussing risks and discussing violations, and exchanging illegal information. The joint efforts of the local customs and the port customs to prevent infringement and "port drift" are more efficient and effective. Shenyang Customs cooperated with Nanjing, Qingdao, Urumqi and other port customs to seize more than 5,000 infringing tires; Xiamen Customs and Nanchang Customs jointly carried out risk research and judgment and seized 140,000 packages of infringing wet wipes; Guangzhou Customs seized more than 400 batches of outbound parcels sent by high-risk personnel according to the risk points notified by Jiangmen Customs; Lhasa Customs and Nanjing Customs carried out a "Case-based Explanation Exchange Seminar" to carry out exchanges and discussions on the whole chain of preset cases, such as on-site investigation, case handling, and risk control.

Customs in Beijing, Shijiazhuang, Shanghai and other areas have jointly carried out special law enforcement actions with market supervision and other departments to strengthen the joint force of crackdowns; Xiamen, Qingdao and Nanning Customs have relied on the mechanism of "linking the two laws" to assist the public security organs in dismantling several dens for making and concealing counterfeit goods and arresting a number of criminal suspects; and Dalian, Hangzhou, Ningbo, Chengdu and other customs have helped cities (regions) under their jurisdiction to be rated as cities (regions) for the construction of national intellectual property protection demonstration zones.

(3) The interaction between customs and enterprises is more accurate and in-depth.
